Has anyone lost to a tenant declaring bankruptcy after avoiding paying any rent for all that time, due to COVID (government says they still owe it and must pay but,..)
Tenant owes over 20K in back rent and is threatening moving and declaring bankruptcy now,

I guess because they didn't have to,..AND were making a very good income, Another tenant told me that they were told by them that they were saving all that money to use for a down payment for buying their own place.

Sue them in court,you will need an attorney for that amount,if they file bankrupt then they wont be buying a house,if they want a house and dont file bankrupt the bank will require them to pay you before they get a mortgage if the house is in the county where you file the judgment --74.77.xx.xx |

Not due to covid but due to irresponsibility, one of my former tenants was getting a divorce (no kids involved) and he declared bankruptcy, wiping out the rent he owed me. However his former wife did not file the big B so I have a judgement against her; not that I'll ever see the money. Joint and several liability! --72.231.xxx.xx |

My experience is that threats of bankruptcy are usually made to gain leverage in negotiation. Maybe tenant is trying to get you to offer to take less money.

Have had three different tenants file bankruptcy where I was concerned. All owed me hefty amounts (not 20k).
Last one might have screwed up and not finished his classes or some such as I got notice that the bankruptcy was not allowed because he didn't follow thru.
Was going to have my lawyer go after him again but he owes almost 20k to a funeral home he stiffed and they are ahead of me. --107.147.xx.xxx |

who cares if they threaten to move, haven't you filed for eviction or at least give them notice of non renewal? them staying has no relation to you getting back rent. their actions tell you their intent. get the other tenant to put what they were told in an affidavit. --172.58.xxx.xxx |
