unless your state bans source of income discrimination, it is legal.

how would it be discrimination if they are only stating they want Section 8? Typically, discrimination is when you state "NO" Section 8/ public assistance, etc.... of course, that's if your state/area has a ban on source of income discrimination.

Interesting thought though ... I wonder if NYS would allow "only S8/ public assistance" vs "open to all".

Of course, if it's public housing ... they limit it. I ran into one the other day that the tenant said "do you have an income maximum?" I said "what? Max? no ... minimum is 3x the rent ... he said "well, I just came from a place that said I make too much money (and it isn't public housing). crazy... --69.201.xx.xxx

The home is only listed on affordablehousing.com but market rent folks are asking. I am showing it to them but at this time my preference is section8. If I don't find a qualifying voucher holder then I would open it up to market renters. Thought that was fair enough then I was thinking maybe that was a bit reversed! --172.56.xx.xxx

Personal experience with government subsidized tenants is a lower class of tenants who are more likely to be problematic tenants. If vacancy rates are low then it is better option to go with market rent tenants where less issues along with less likely to use illegal drugs. If can get a higher market rent then over time there will be the funds to replace the roof, heating system, water heater, windows, plumbing system along with renovating kitchen, bathroom along with appliances. Rental units or houses the life expectancy is lower then owner occupied house as people care. A rental property takes funds to be put where putting money in a investment takes zero. A metal roof is more expensive upfront but over time the roof will cost less as the metal roof will outlast a shingle roof many times over. Since installing a metal roof on house the house next door has gone through shingle roofs. So spending $5,000 in 2005 has paid off. We too have a good hud office. i had an indpection today and inspector said they appreciated me!

My ad says Section 8 Welcome, and when i get a “regular” person interested, i dont deny them but just respond that my business specializes in renting to voucher holders. They usually get the message. --96.37.xxx.xxx

Discrimination is favoring or not favoring one characteristic over another competing characteristic. Whether it's illegal or not depends on if that characteristic is a protected class or not.
