Anyone have luck filing this on their own in PA? Debt collections won't touch it as it is not big enough for them and CC sheriff's department advised an attorney. I am making calls and emailing but just curious to know someone's success rate. The judge seemed to think it would be pretty easy for me to do on my own at the hearing. --73.230.xxx.xx |

I used Dornish Law over in Pittsburgh
He files a “Praecipe to Enter Judgment” that is governed in part by PA R.C.P. Rule 237.1. I am not sure what county you are in but in my county -which is rural, they are strict about this as it is at the county level. --24.101.xxx.xxx |

Do some searching on the internet. I did about 3-4 or them and all were successful. Also, ask the prothonotary at your county building, they will not give legal advice, but they will tell you what's needed for the writ of execution. When you ask say "I know you cant give legal advice out, but I'm asking about your requirements to do the writ" and they'll hopefully respect you and give you the info. --74.99.xxx.xxx |

Are you executing at the magistrate or common pleas level?
At magistrate level, they have the paperwork at the counter (most likely you've got to ask for it) and the constable takes care of it. They levy on all the defendant's worldly goods and hang the list in the lobby of the magistrate. Not sure but the actual sale is scheduled perhaps 2 months out - a long time for them to dispose of and destroy the good stuff although that is technically illegal. Trouble is, if this "scare" tactic doesn't work, you now own and must immediately remove at time of sale the possessions you've just bought. Now you need to store and sell them to hopefully recoup your cash.
If you have already filed your judgment with the Prothonotary, the sheriff takes care of it when you file the actual Writ. They will attach whatever you tell them - bank accounts, personalty, vehicles, etc. If they have a GOOD job they aren't likely to quit and if you think their expendable income meets above the governmental poverty limits are, you can garnish their pay - but you will receive perhaps $25 a week and depending on your judgment amount, that will take forever. Should they lose their job the money you've expended to that point gets added to the back end for when you pay again and start over again.

Thanks. I was at a closing at his office. Filing the judgement tomorrow. Both have vehicles. Both are living with others so figuring anything decent "wouldn't belong to them". Just have to move forward with it. He has a decent job, she is couch surfing. --73.230.xxx.xx |

A few times. Just like a lot of this landlord stuff though it's what they don't tell you they bites you in the butt. The one time the sheriff knocked on the door and showed the tenant the paperwork and the tenant said I refused to let you in so the sheriff left and banned that was just 1 big waste of money the sheriff sent me a letter telling me he needed a break in and enter order --71.207.xx.xx |
