It looks like they may accept our offer, $22,000.00 for 1/2 acre lot with septic system in place. (On 06/22/22) It does have an older singlewide that is livable.
We've gotten a verbal approval from health dept guy but it does have to go through proper channels & be documented. So plans are to get a drilled well in front of the unit, however, realtor has suggested that the seller is willing to grant us an easement onto his property on the backside of us if we cannot get water in the future for some reason.
My question is:
1. Do we ask Health Dept. to lay out alternative place for well in addition to where we are drilling on our lot? Won't that need to be noted on a survey and recorded at courthouse so that if it is sold in the future it continues? Or would a simple deed restriction of some kind be adequate? --216.126.xx.xxx |

I would put it on the purchase contract that he said i could put a well on his property if need be then inform my attorney to have it put in the deed however it needs to be done.I think it would have to be put into the deed of his house which might require more paperwork being done which noone will want to do so you will need to make sure it gets done,i do not think a deed restriction would be correct --74.77.xx.xx |

Yes, I agree. We bought a repo 20 years ago that had easement recorded on plat of next-door neighbor who was her father. People don't think about what will happen if they sell or lose it. It was for septic expansion if needed, but it's the same principal. --216.126.xx.xxx |

Easements get recorded and they can also be removed. We had an easement for the neighborhood well on our property. When they went to individual wells, they capped the well, returned the land to it’s natural state and removed the easement from our deed. This allowed access to a buildable part of our land allowing us to subdivide. Do not trust a verbal or handshake on this. Get it recorded. If it’s not needed in the long run after you drill the well in the front, remove the easement. --75.67.xxx.xxx |
