I have heard some landlords have in their leases a clause that if a guest stays there over 14 days per year they will need to prove they live somewhere else by providing an electric bill in their name and a lease from somewhere else OR be added to the lease and the rent goes up $150 per month. Now there is a problem that maybe I would not want that person to move in, but my question is, I think it would be wise to allow the “roommmate/ boyfriend/ girlfriend to move in with the added monthly amount AND change the lease to a month to month agreement if the original tenant was on a year lease. This would allow me to have more say over the property. My experience has been that once my original tenant moved a significant other into the apartment there has been only trouble. Any thoughts?

Had this happen more than a few times in 25 years. Significant other, brother, sister, mom, friend, cousin...you name it. I put a clause in my lease that says any more than 3 consecutive days they must pay a fee of $5.00 a night for the rest of the days in the month they stay. Starts over each month as I'm month to month. I also included a clause that allows ME to determine if a 'guest' is staying on a permanent basis (you have to watch and it's time consuming) and then if they aren't causing any grief for me, invite them to be a tenant (if they qualify which they probably won't or they wouldn't be mooching off a friend) OR I can just keep them on the 'guest' status forever which nets me approx. $150 a month extra which covers the extra water use. Working well so far, but it either has to be in the original agreement or you have to write an addendum. --174.65.xxx.xx |
