As Ray asked what does your rental agreement say about this? Normally if there are multiple parties occupying the same unit, they don't each have individual rental agreements. Unless you are willing to release the party moving out from their responsibilities outlined in the rental agreement, nothing should change. If you are willing to accept that there will only be 2 tenants now responsible for the rent, go ahead & release them one moving from the agreement. As far as the SD goes IMO it should always stay with the unit until everyone moves out & properly returns control to the LL. The person moving out & the 2 remaining should deal with who is responsible for any damages at this point son that when the last 2 leave they can't try blaming it on the first one to leave. --72.93.xxx.xx

Steve is spot on.........unless you are running a boarding house or college rental and renting out induvial bedrooms. That really isn't the norm.

In most cases the house rents as one unit.

As exciting as it might be to see who gets voted off the island this week, you are not getting possession back.

In Pa Possession in L/T law (Act 129) is defined as either getting the keys or finalizing the eviction process to include the lock out --24.101.xxx.xxx

I do not know if your state laws have different requirements, but I am set up so that the lease, the rent, the deposit, the (insert everything) is all one and runs with the lease until all renters have vacated the premises and returned possession to me.

This runs on the K.I.S.S. principle. This requires the tenants work it out among themselves. The remaining tenant can pay Bob "his portion" of the SD when he leaves and then the rest is theirs to do with as they please.
