I have a tenant who has a small dog. She accesses her apartment over a roof. Last year, I saw dog poop on the roof and confronted her about it. Last week one of my contractors saw the dog doing number 1 on the roof. I think that's tacky, trashy and unhealthy. I think I have two choices; give her a notice to quit or just terminate her m2m agreement. She's been there for 3 years and may have reached the end of her shelf life. Rent is below market (I recently raised her rent) and I could turn the apartment and put someone else in at current market. Probably would cost me $ 3000 to turn plus a month or two vacancy. Alternatively, I could leave her in place with a stern warning that I will terminate if I catch this again. The problem with that is monitoring compliance. I plan on placing a camera in the area which I have to do anyway. How would you handle?

Check your lease wording, then issue a Seven day notice for a violation of your lease. If it happens again within 12 months you have the right and the proof in your file folder to move her out. You tried to work with her and didn’t just put her out on a whim. If she has been there that long she may be particularly upset if asked to move. Build a case.

I have a similar access. The upstairs apt access is up an exterior stairway then across the first floor porch roof. Kinda like a boat dock.

We added side railings for safety but kids were still ducking under the rail. HUGE safety issue.

We added the sturdier plastic crisscross panels under the rails to eliminate bodily access to the roof.

MY job as manager is to put physical boundaries in place for safety and what I want, like RR ties to contain parking.
