Hi I just want to confirm the amount I have to pay the tenant. I got screwed on this one. I have to pay $721 on or before May 11th plus post judgment interest of 10%. Judgment was entered on 10/7/22. Do I just add 10% of $721 and add that to the $721. Can someone confirm the amount. --71.234.xxx.xxx

I figured it out. For post judgment interest you take amount owed multiply by percent the court awarded and then divide it by 365 days to get the daily interest amount and take that daily interest and multiply it by how many days from judgment until paid.

Ex $721.00 judgment amount multiplied by 10% (post judgment awarded) which equals 72.10 divided by 365 (how many days in year) which gives you the interest per day 0.1975 and then you multiply that by the days from judgment entered until day paid. 212 days (10/7/21-5/7/22) which is $ 41.88 Interest plus judgment amount equals $762.88 --71.234.xxx.xxx

Well DJ since you asked, here goes. Tenant gave me 1,750 for security and pet security plus first months rent. When it was time for her to move out she cleaned the apartment but her dog a large pitbull in an efficiency apartment did a lot of damage to the floors hardwood also scratched up the windowsills and broke all the blinds she did damage to the door, the wall everything together at a reasonable rate was $960. I deducted that money from her security of 1750 and I sent her the balance. She went ahead and sued me in housing court saying that she had given me about $3000 and then I only gave her about 783 back and that I owed her more. She did not take into consideration of damage and included first months rent that she would not get back anyway. They set up a hearing and we both had to call in to the Hearing ( by the way in person is much much better) I submitted pictures of the damage. The day of the hearing the judge saw the pictures and asked the tenant if she contested any of the damage, the tenant said she cleaned it up and the judge said since she did not have any pictures from the tenant, she could not prove that she didnít do this damage so what the judge did was she only took off $60 for door damage but the rest of the damage was granted. The tenant got the judgment for $960, 810 plus court costs. Remember I paid her 783 already so I sent her the balance to make up the $960. She tried twice to attach our bank account unsuccessfully and I decided to ask court to clarify the judgment amount and have her submit satisfaction of judgment. The court set up a new hearing and a new judge was assigned. The new judge did not even look at the judgment, did not account for damage and required me to pay this tenant an additional 721 plus interest. I was so upset because the new judge rushed the hearing did not look at any prior documents. I went to an attorney for a free consult and he said I was correct and that I owed her nothing. At this point I would have to file a motion to reopen and itís mot worth it. I did the best I could to save us money and should have won but next time I will lawyer up or appear in person not over phone. --73.61.x.xxx

Since you can't get this judgement off your record anyway. I would and have appealed a tenant judgement to a higher court.

WON that one because the judges are really judges and know the law. Even though won on appeal the judgement still shows and it has to be explained when applying for credit. --99.103.xxx.xxx

Well myob in CT where I am from those types of judgments don't affect your credit been told that by two attorneys. Also, I was advised housing court matters cant be appealed. I would have gone that route if I could. --50.241.xx.xx

Well Sharon I can't argue that because I'm not form CT.

I would love to see your credit report though--- if it's at the court house and in the record-- well again I'm not there.

It is funny that you can't appeal to a higher court. Here in GA we go from Magistrate court and appeal to either State Court of Superior Court. When I appealed I skipped the State court and went for broke with Superior Court. I will say Sharon when I appealed it was all new-- there was no input allowed from the Magistrate court decision. We filed a whole new case.

I'm sorry to say I don't believe those lawyers. Maybe some other LL's from CT will chime in.

Like myob, I've got no idea how Connecticut works. However, and I seem to think this is federal, I believe judgments no longer get reported to the credit bureaus unless the judgment is filed with your social security number and I'd guess the majority of civil suits do not have socials attached anywhere. --98.237.xxx.xx
