WHEREAS, the Tenant desires to keep a certain animal described below on the said premises and the Rental Agreement specifically prohibits allowing animals on the premises; the Rental Agreement is hereby amended to grant such permission to the Tenant. In exchange for this permission, the Tenant agrees as follows:
1. To pay additional rent in the amount of $25.00 per month
2. To pay the Owner/Agent a "Non-Refundable Animal Registration Fee" in the amount of $100.00. Tenant acknowledges that the amount of the Non-Refundable Animal Registration Fee is reasonable and agrees that the Landlord shall not be required to refund the Animal Fee in whole or in part. This Animal Fee is non-refundable.
3. To keep the animal from causing any annoyance or discomfort to others and to immediately remedy any complaints concerning the animal;
4. To keep the animal from damaging any property belonging to the Owner/Agent or others;
5. To immediately pay for any injury, damage, loss, or expense caused by the animal. It is expressly understood that at no time shall the Resident apply any part of the Animal Fee towards such amounts due, but rather, the Resident shall make restitution immediately and separately from the Animal Fee. It is further understood that such restitution shall be made over and above any rent paid in accordance with Item #1 of this Animal Agreement;
6. To keep the animal under control at all times;
7. To keep the animal restrained, but not tethered, when it is outside of the dwelling;
8. Not to leave the animal unattended for any unreasonable periods;
9. To hold the Owner/Agent harmless from all liability arising from the Resident’s ownership or keeping of the animal, including but not limited to any liability resulting from the Owner/Agent turning said animal over to local animal policing authorities should the animal be found unsupervised;
10. Never allow the animal to defecate on any property, public or private, unless the tenant immediately removes the waste. Always carry equipment sufficient to clean up the animal’s feces whenever the animal is in the common areas or off the tenant’s property. Properly dispose of waste and/or litter.
11. Not to leave food or water for the animal outside of the dwelling;
12. Not to breed the animal;
13. Tenant MUST include these animals on their Renter Insurance Policy.
14. Tenant MUST have these animals licensed and vaccinated according to NC law
15. Not to flush cat litter down the toilet or any drain and to regularly clean the cat litter box.
No animal of any kind, not provided for and described on this agreement shall be allowed without the full written consent of the Landlord. Tenant understands and acknowledges that should any local ordinance or rental agreement violations that can be attributed directly or indirectly to these animal(s) will require the Tenant to immediately remove all animal(s) involved from property within 72 hours after receiving written notice from Landlord.
Removal of Animal: The Tenant shall remove any pet previously permitted within 72 hours of written notification from the Landlord that the pet, in the Landlord’s sole judgment, creates a nuisance or disturbance or is, in the Landlord’s opinion, undesirable. If the pet is caused to be removed pursuant to this paragraph, the Landlord shall not be required to refund the Pet Fee; however, the Tenant shall be entitled to acquire and keep another pet of the type previously authorized.
