State Specific Question About: NEW HAMPSHIRE (NH)
Hello,
I had a tenant that didn't pay rent for 6 months, they were evicted, and I received a judgement on the tenant, but the tenant has not made any attempt to pay the judgement. This tenant has a decent job and has been employed at the same job for a number of years but in NH their wages cannot be garnished.
In NH to collect on a judgement we have to file a motion with the court. The motion is a “Motion for Periodic Payments” and the defendant must complete a form listing all of their current income, provide all assets, list any dependents, debts, living expenses, (current rent, utilities, auto, insurance, etc) and based on this information the judge decides if they can pay the judgement and if yes, how much they can pay each month.
I filed the motion months ago and recently received the date the tenant and I will be in court to review this information and a decision will be made.
I wanted to know if anyone else has been in one of these proceedings or similar situations and if so, what can I expect or what should I be prepared for ? Will I be able to question the financial information provided ?

Bob, another useful site is NH Legal Aid. If you Google that and motion for periodic payment it will give you a list of exempt income. You can use that site which is written for tenants to understand the eviction process, bed bug laws, etc. It explains to tenants various processes and what landlords are allowed or not allowed to do. If you have not already done so, please contact your local representatives and ask them to vote against HB1291 which would make Section 8 a protected class. If that passes you will no longer have a choice of choosing not to take section 8. If you need more information if points to include in you letter, let me know. --75.67.xxx.xxx |
