State Specific Question About: FLORIDA (FL)

As feared, tenant tried to commit suicide in condo when given notice to vacate. Was in hospital 10 days and went back to condo. Seems cold to me, but under advisement I did start eviction process. Tenant tried second suicide attempt in condo day before official eviction notice was posted to door. Another 10 days in hospital. In fact, tenant may be getting out today. Then he has another 5 days before eviction is final, which means he's all in, and I, of course, have no rights for another 5 days. Attorney told me I've done everything right as far as eviction. Any advice is much appreciated. Were it not for fact that he has now proven that he isn't stable, I'd probably let him stay and live out his life there. It would be easier than this. Don't even think about letting him stay. You simply can't allow a tenant to blackmail you. And you had better hope that the courts don't decide that a fake suicide attempt is a good reason to rule that a tenant has a lot more time before he can be evicted. --76.178.xxx.xxx

All morning I've hated myself that I listened to any attorney or family -- that I should have just nicely kept asking him to move and wait till I keel over from worry and exhaustion. Again, we did become friends over the years and had some great conversations. It pained me to feel that I might be pulling the rug out from under him, as he seemed to be -- not necessarily happy but -- comfortable there. If I were a real millionaire, I would let the person stay and find a way for them to work off the debt or find a charity to fund him or find work at home for him or her. But since we are not and are under threat by government, it's probably not an option for you. If you are a real millionaire, perhaps you can find a way. It's tragic that someone is so unable to care for themselves that losing that apartment causes them to choose death. I would solve this somehow without eviction or move the person into a mobile home somewhere. By the way, if he or she dies, they will still be in the apartment. I have some folks in one of my buildings. The female has spoken to me and helped me find something that was misplaced there. I saw one of them on the stairway when I brought my dog over for company. He or she came up the stairs to see the dog. I also have photos of large orbs. Better you get cheaper housing for this person out of your building somehow. --108.24.xx.xx

Thank you, Allym. I probably should have noted that money is not an object here. He has always paid faithfully, and I don't think that is his struggle. But as I am getting up there in age, I wanted to sell now, since it's a good time to sell. Then for once in my life I could have some money to make my life a little easier -- maybe redo our 40-year-old kitchen, take a vacation for the first time in a decade, etc. Had I known things would be this volatile, I would have just kept things status quo. But, then, I'm probably not cut out for this. I only became a landlord because I got caught in the housing crisis of 2007 and that was the best move for me at the time. I can feel empathy and even feel sorry for some of our tenants' life travails, but this is a business and I cannot afford to carry someone else - if I wanted to lend money to people (I don't) I will give it to my own family first. As I tell ALL prospective tenants "If you ever have trouble coming up with the rent, call your OWN family, not us."

Anytime a tenant doesn't pay rent, that is $1000 or $1200 or $1600 that I don't have to help MY family. I'm sure any one of my kids or grandkids could use a grand or two if I were inclined to give it to them. Which I'm not. But I'm REALLY not inclined to give to a "stranger."

Your tenant may well kill himself, but it's NOT because you want to sell your house and get out of landlording. There is more wrong in his life than that or it is total emotional blackmail. --50.82.xxx.xxx

In the meantime, since this is not a nonpayment issue, look around and see if you can find someone offering something comparable for the money since this person does not have the strength to do so. I suspect that money isn't the issue. The issue is that this tenant's threats, manipulation, and emotional blackmail is destroying OP's peace of mind.

Without apology I say that two failed attempts in a couple of weeks are not serious attempts at suicide. They are manipulation to make people around him feel guilty and give him his own way. If people are serious about suicide, they get the job done. They don't make attempt after attempt that only get them hospital time and sympathy.

OP if he needs your emotional support and if, for some reason, you want to give emotional support, you can give it to him just as effectively after he is out of your house.

No one, absolutely no one, ever commits suicide because they might lose their house. This tenant has much more serious issues than housing, and OP asking him to leave is not the root cause of his emotional dysfunction. --76.178.xxx.xxx

I had that all typed but deleted it. However I totally agree with you. I have had friends and family commit suicide and they didn't dither and attempt. They DID it. Almost all with no real warning. And all with NO POSSIBILITY of outliving the attempt.

Only exemption is my BIL who chose his own date and time of leaving this life on his own terms, for very valid health reasons, and he informed his whole family it was going to happen and spent about a year preparing them with stories and correspondence and research to make sure it was NOT an attempt but a success. It is not the landlord's responsibility to find new housing for a tenant. I would not risk a professional reputation by connecting this tenant with a realtor friend. The tenant that has 2 suicide attempts has access to professional medical help. Let their social worker, counselor etc deal with help them cope with life. For the people who suggested I try to help him find another place, I have sent him links, phone numbers, and photos, all to which he didn't respond. He's acting like a "spurned tenant," if there is such a thing. My boyfriend and I went into the condo for 30 seconds to make sure the doors were locked and noticed a propane tank by the front door. Is that a nothing burger, or should I worry about THAT now? Thank you so much, All!

I would highly doubt someone makes two suicide attempts simply to ďblackmailĒ a landlord. That thought process in and of itself would point to some major mental health issues. That being said, you should not feel bad about evicting. Itís a business. I think itís pretty sickening though for people to say ďmaybe the third time will be the charmĒ. Gross. The tenant definitely has mental problems, far beyond what any landlord is qualified to deal with. His health problems are not OP's responsibility.

The man lives all by himself in a condo. The only way he ended up twice in the hospital for a suicide attempt is if he makes the attempt in the middle of a very busy intersection, or else he has called the police himself to report that he has made the attempt and that they need to hurry to save him. He might be calling out for help, but he is not trying to kill himself.

OP can't fix his problems. The tenant needs professional help and maybe should be locked up for more than 10 days. OP needs to go ahead and get him out before he is placed in a mental hospital and has left the OP to try to get his stuff out while he is locked away.

Facetious, by your own name, try to understand what OREGON meant when he said, "the third time is the charm." HE was being facetious, and his comedic timing was impeccable. I have been so stressed out by these events, and when I read that, for the first time in months I howled with laughter and relief. That's why we love our comedians! Life in and of itself can be a tough business. I would like to think that most people who had only one tenant for almost 12 years would like them well enough to be invested in their well-being -- but that's just me. Did I miss WHY are you evicting?

I agree he is unstable.

My concern is lost wages while hospitalized.

Also, his next attempt might damage the home or neighbors. Bullets go thru walls, fire, explosion...

Know that the police do not clean up bodily fluids after a death. That's up to you.

If so contact my friends at Crisis Cleaning here in Indiana for advice.

Never read emotion into a text or non-replies. Why do you think he feels "spurned"? Just stick to the facts.

LL Rule #3 Don't let their problem become your problem.

Unless you are a trained counselor stick to the house issues.

Thank you, Brad, for also helping to clarify that I need to be aware of boundaries and what is appropriate. It's easy to let emotions run the dialog. (So glad I never did Twitter or Facebook). "Spurned" meaning only that for the same reason that I may have been "invested" in my tenant, he may have had hurt feelings to be given a notice to vacate after almost 12 years. But I was aware that there were issues with my tenant that I was not prepared to deal with that were becoming more problematic and could eventually filter out into the community. IMPORTANTó it looks like people didnít notice the OP said there was a propane tank in the condo when she went to secure the premises after the second suicide attempt. This is a very big deal. A propane tank should never be inside a building. Considering his mental instability my mind first thinks he is either planning to blow the place up or use the tank to create carbon monoxide. Given that itís a condo building he is putting all residents in extreme danger. I would see if Florida has an emergency eviction process to get him removed immediately given the perceived harm he is placing other residents in. --69.168.x.xx

I had actually forgotten about that (yikes), so when I go this morning to check on things, I'll take it out even though I'm not supposed to be allowed inside the premises until the official eviction process is over.
