2 1/2 YEARS AGO, THE COURT ORDERED ONE OF MY TENANTS TO GIVE UP HIS APARTMENT AT THE END OF THE MONTH - WHICH HE DID.

AT THAT TIME, HE WAS ALSO ADJUDGED AS OWING ME $3,750.00 IN BACK RENT HE OWED ME - WHICH I BILLED HIM FOR, BUT HE NEVER PAID. - AND NEVER EVER RESPONDED TO.

BECAUSE I WAS OUT OF THE THE COUNTRY AT THAT TIME, I NEVER GOT AROUND TO TAKING HIM TO COURT ETC.

SO MY QUESTION IS: IS IT NOW LEGALLLY TOO LATE FOR ME TO TRY SOMEHOW GET THIS MONEY FROM HIM? THANK YOU

Sounds like you got the judgment already or if not call the court clerk and ask what you need to do to get the transcript of judgment.Once you have the judgment file it at the county clerks office.See if he is still working where you knew he was last,if yes then then fill out the paperwork for the sheriff and have him go after the wages.If you can check the clerks office and see if he owns a house now also --72.231.xxx.xxx

You should read exactly what your judgement says. Normally in MA the prevailing party is entitled to collect 12% simple interest on court awarded judgements.

Statute of Limitations for Lawsuit

Massachusetts statute of limitations for filing a lawsuit on open contracts — credit cards — is six years. Sales contracts carry a four year statute of limitation and specialty contracts under seal carry a 20 year statute of limitation. If a creditor or other party to a contract brings a lawsuit against the borrower or second party to the contract after the statute of limitations has expired, the lawsuit can still be decided in favor of the originating party unless the defendant submits an affirmative defense based on the statute of limitations.

Time-Frame for Judgment

Once a judgment is issued in the state of Massachusetts, it is valid for 20 years. This means that the winning party has 20 years to pursue collection by means of bank account levy, real property liens and property seizures. The judgment can also remain listed on the losing defendant’s credit report for the 20 year time frame. In Massachusetts, judgments carry a 12 percent rate of interest until satisfied. --71.174.xx.xxx

I have the same issue.

The judgement was granted from the judge in April, 2017. the ex-tenant is still not paying nor responding my requests of paying the overdue rent.

In Texas, we can not garnish the wages. so, we are not sure what exactly the judgement can do for us. I am not even sure that the judgement is in their credit report?

I wonder when those tenants owe rents, they became a good guy, the landlord became a bad guy. What kind of world are we in?

(I tried to contact their original references and tried to get their current address other than email address, but those references were rude including their own parents.)

Please let me know your recommendations. Thanks.

File the judgment at county clerk office where they live,once or twice a year former tenants call me because the filed judgment needs to be paid before a bank will give them a mortgage.They call nice as pie now that they need be,add up the interest and give them no breaks --72.231.xxx.xxx

Wow you get 12% in MA! I thought that the 8% that we get was crazy.

Now if only you can collect on it.

Have one deadbeat that contacted the bank who contacted me. Seems she wants to pay off the 2k that I have a judgement against her for. She now has a hyphenated last name so I am guessing she re-married and maybe they are trying to buy something expensive.

I gave the phone number to the collections lawyer that already had the case. No way was I going to just collect without at least going thru the courts. --107.147.xx.xxx

zero hate to tell you but if you have a judgment--YOU'VE BEEN TO THE COURT TO GET IT.

If all would just check out what your doing there's a lot more corn in the field.

We add on 25% collection fee (the same amount a collection company chrges) then 12% interest per annum. The interest is unsecured debt-- so soemwhathigher than mort int.

Ken it is amazing how NICE they now become. We suggest when dealing with debtors--ALWAYS PULL THE PIC FILE OUT and as they try to sweet talk U look at "how they left your place".

My collection manager does not allow the "GEE they had a problem so lets be soft" and why? because even with problems they (tenants) don't have to live like pigs!!!! --72.2.xxx.xx

Michigan I think is 7 years an then can extend it...never had one that long

I have 8 cases where they owe me money..some about 4 years old.. charge 12% interest on them

I have 5 of 8 being garnished at this time from employer

Listen to MYOB (and the others). I did and have gotten almost $14K so far.

I add the 25% collection fee.

Also I put in my rental contract that with judgments and collections I can charge 12% interest. This is from the time of court judgment. So if it takes me 3 years to find them and start collecting I have already added 12% of their judgment amount to the taotal amount due to me.

My state (MO) has automatic of 10% interest --173.187.xxx.xxx

When do you guys add on 25%? i cant go into small claims court and say a tenant owes me $1000 for damages and add a line that says 25% for collection so now they owe me $1250 --72.231.xxx.xxx

The 25% is added to the charges when you send (have sheriff serve) the paperwork to their employer for garnishment.

This is AFTER the SCC hearing and you are awarded judgment.

This is placed on a form the court supplies showing how much they owe.

It is form CV 92 (used first time) and then CV 93 (used for following times) here in Missouri.

You should be able to go online and look at a copy of the form.

Last judge wouldn't allow collections fees. Said it was unfair to the tenant and an added burden. Court allows 8% interest. Not sure if that is just this court but that's what the new judge says.

Maybe I need to ask the new judge about collections fees. If I turn it over to a collection agency they take a chunk of my winnings, whereas I used to add that to the judgement. --107.147.xx.xxx
