I have a commercial tenant who left in April 2020 bec of pandemic. His lease doesn't end until end of 2022. Should I sue him for breaking the lease ? in New York City BTW. Thank you. --72.229.xxx.xxx |

If you didn't try to mitigate damages by trying to re-rent it, you have no cause for damages.
I had a tenant move out leaving some equipment behind. I found a new tenant who wanted to rent the space with the equipment inside. The new applicant wanted the old tenant to sign off on the equipment, but the new tenant refused. So when the lease was over, I was able to sue the old tenant for a few months of lost rent. I had to have the applicant show up in court and explain that the owner tried to work with the old tenant but the old tenant wouldn't lift a finger to help. --47.155.xx.xxx |
