Iv got a person who wants to rent my apartment. They say they are in the 3rd year of a bankruptcy ---- Is what a negative event for me or what can that event effect me renting to them in any way?

I’d screen them like anyone else. I’ve rented to people who lost houses, filed bankruptcy etc….

How have they been managing things since the bankruptcy is my concern. Half will be desperately trying to prevent it from ever happening again and do everything to protect and rebuild their credit. The other half will fall right back into the same habits that got them there in the first place.

My concern in the example you gave is the fact the bankruptcy was only three years ago. I have had a couple of excellent former bankruptcy tenants but their bankruptcies were more like five or six years old.

I’d also consider the source/cause of the bankruptcy when deciding. Was it due to a divorce, an illness causing a job loss or general bad spending habits? --24.96.xx.xxx

Three years in so they can’t file again for another four years. Pull a credit report to be sure of the facts. I look at the debt and it was Medical I would consider but if it was a new car, TV, vacations dinning out No.

I have done this successfully. Could work out if they otherwise qualify. The now know the pain and most want to avoid filing ever again. The question is "is the bk closed" so no more can be added? Ask for bank statements and verify what they bring in and where it goes. I'd rent to them. --172.58.xxx.xxx

The BK is not closed, there are 2 types of BK,chapter 7 and chapter 11. One of them wipes out everything,the other has a 60 month repayment plan. I am not sure how they decide which you get but i would think it has something to do with wanting to keep a vehicle or a house.In this case he is still making payments and i believe he needs permission from the trustee to take on debt which would include renting an apt. --72.231.xxx.xxx

I've rented to several bankrupted persons and couples. It depends how long ago they were granted their bankruptcy -- they can not file again until after a 7 year period.

But their latest credit report has to show they are not racking up debt again and have minimal debt to service. --47.155.xx.xxx

Actually there are more than two types of BK Ken, but in this specific instance the prospective tenant sounds like a BK 13 which is a personal bankruptcy with a repayment plan.

If you want details on the specific BK go to PACER and download the court documents for your prospective tenant. You can then see the creditors and the repayment plan and make a decision from there. --104.0.xx.xx
