Judge apologizes for berating cancer patient who's too weak to clean property — and reports herself to state commission that probes judicial misconduct

A Michigan judge who was caught on video chewing out a 72-year-old cancer patient — and even saying she'd like to throw him in jail for failing to maintain his property's exterior — has apologized for her behavior.

Hamtramck Judge Alexis Krot said in a Tuesday statement that she's even reported herself to the Judicial Tenure Commission, which the Detroit Free Press says investigates judicial misbehavior in the state.

What's the background?

Burhan Chowdhury appeared before Krot in a virtual hearing earlier this month for violating a city ordinance requiring property upkeep.

Out of breath, Chowdhury explained that he's a "cancer patient" and "very old" and "very weak" and hasn't been able to "look after" the overgrown exterior of his property, Insider reported.

But Krot wasn't too sympathetic — or even cordial, telling Chowdhury he should be "ashamed." His offense was apparently so serious that Krot added, "If I could give you jail time on this I would."

The judge fined Chowdhury $100; the payment is due Feb. 1.

But when the defendant's son spoke up and asked Krot if the fine is "forgivable" due to his father's health, the judge got even more fired up.

“Have you seen that photo?" Krot hollered.

"I am very sick, ma'am," the elder Chowdhury replied.

"That is shameful! Shameful!" Krot yelled back. "The neighbors should not have to look at that! You should be ashamed of yourself!"

Chowdhury’s son, Shibbir, told WDIV-TV his father was diagnosed with cancer of the lymph nodes in 2019 and that his treatments have taken a toll on his mobility. Shibbir Chowdhury added to the station that he and his mother have been trying to maintain the property.

“I usually take care of the stuff in the backyard and everything, but that time I was out of the country,” Shibbir Chowdhury noted to WDIV, adding that the judge "should have [spoken to] my father more politely."

The family told the station the overgrowth has been cleared and that they will pay the fine.

Backlash

After Krot's behavior toward the elderly defendant went viral, a petition to remove her from the bench began circulating and has attracted over 234,000 signatures as of Friday morning.

Krot's antics also drew criticism from immigrant advocates who said the incident reflected hostility that some minorities and immigrants face in local courts, the Free Press added.

'I made a mistake'

And while WDIV reported that Krot — who was elected to the bench in 2018 — wasn't permitted to comment on the story, she soon issued her apology.

"I made a mistake," she wrote. "I acted intemperately. I'm very embarrassed that I did so. I apologize to the person who appeared before me and to our entire community for having failed to meet the high standards that we expect of our judicial officers and that I expect of myself."

Krot added, "When someone appears before me and has made a mistake, I expect them to own up to it. I expect nothing less of myself. No ifs, ands or buts: that is the reason I self-reported my behavior to the Judicial Tenure Commission. I had no legal duty to report myself to the Commission, but I did so because, like apologizing to the community, it was the right thing to do. I will continue to hold myself to the standards I set for others."

Shame that neighbors don't help a fellow out. Or, maybe the homeowner is hostile to neighbors. Certainly, i don't know. But, trimming things up a little for a neighbor doesn't take but a few minutes. --70.92.xxx.xxx

There is always more than one side to a story.

Prove all these allegations.

Out of the country? Not a single person to help? Not a single call to anyone or any do-gooder org for help.

Also, notice how it's always certain people that want free passes and special treatment.

Sounds like b.s. to me.

Plus, if this person is so sick and weak, they should be under care and the care should take care of these problems.

You might be right. In most places, Code Enforcement gives you time to fix the problem after the first write-up. It's only after you ignore this that they start to get heavy handed. Could have arranged for a neighborhood kid to mow while son was away. --107.141.xx.xxx

I'm with Richard, lets hear the other side. Brush, it doesn't take over in a few weeks, it takes years. Why didn't the son get it cleaned up before, they didn't have a problem once they lost the case. If the parents are that unable to take care of themselves it may be time to look at a retirement home. --209.16.xx.xxx

The code enforcement happened over the summer. The son was usually does the elderly father's lawn. They were gone for two months in the summer. I assume that this is was when the write ups occurred. The news report did not say whether they had arranged for someone to look after the yard during that time, or if those arrangements fell through.

From the news report that I saw, he appeared ill and had some difficulty in communicating, but did not appear so infirm that he needed to be in a retirement home.

The judge was a bit over the top.

I have had the situation where I have found out that the hired lawn help was not doing their job only by driving by the property. --98.122.xxx.xx

Last I looked, Tenants are totally free to HIRE someone to do the yard work if they can't or don't want to do it themselves. It's in my rental agreement that they keep up the yard (minimal mowing and trimming) and if not, it will be charged against the security/cleaning deposit when they move out. BUT the judge really had a melt down and shouldn't have said a lot of things. I think some judges are just fed up with all the excuses from tenants. --174.65.xxx.xx

I didn't watch the video, BUT, from what I'm gleaning from this thread, the lesson for us landlords: the LESS said the better. State the facts, state them once, calmly, then STOP. Deliver any paperwork, and do NOT engage.

Complain to your buddies over a nice meal out, if you must, but, say only what's necessary to the tenants.

And, from the other side of this court case, to those of us getting older, maybe encountering health problems, live your life with kindness, friendliness, caring. So, when YOU get in a spot, there will be people who will help you out. Whether a fellow landlord, a family member, or just a neighbor. That was a lesson I learned from a most excellent teacher in Special Ed. She said the very most important thing she could teach the kids was to be kind to others, help others, as many these kids were always going to need a 'helping hand'. Those that took others for granted were going to find themselves out in the cold as they got older, or, in this fellow's case, with no one to go mow 'n blow whilst he was away for a bit. --70.92.xxx.xxx
