I have a tenant that is a Pita,.she has been there over 3 years but has been getting so much worse and I want her to leave. She is MTM and I would rather not give a reason for her to try to fight about leaving (she doesn't want to.)
I told her a few weeks ago that I wanted her to leave by April via email,. but now I'm wondering about 2 things. Do I have to send a letter with my intentions of getting the unit back? Maybe certified? And if so,..is it April or May to ask if I send it out this coming week (Before Feb) Thank you for any input on this matter. --66.30.xx.xxx |

What does your lease say? In my state and lease it's 30 days. And the only reason to give on a month to month is that the agreement is not being renewed. At least in my state. --172.58.xxx.xxx |

In NC it's only 7 days on a M2M lease. So technically, I would wait until they paid that month's rent, and give notice that I would not be renewing and they need to be out by month's end, as long as I did it 7 days before month's end. --50.82.xxx.xxx |

New laws in NY, If she has been there less than 30 days she gets 30 day notice,1-2 years 60 days notice more than 3 years she gets 90 day notice assuming she is not in a lease currently and is month to month.NY either has recently or is trying to pass a law saying you cant evict without good cause which basically means PITA is not a good enough reason. --72.231.xxx.xxx |

I usually say to my tenant that I'd normally just give you a 30 day notice to move and be done with it! But I'm willing to work with you and give you more time. You have to give me a signed letter spelling out when your final move out date will be. This is your notice to the landlord about moving out.
They will most always scream, shout and refuse to give you any letter. Then you hand them a 30 day notice and say, If you want 60 or 90 days, you'd better write me good by notice with your move out date. Then they will comply to get more time. --47.155.xx.xxx |

Yes I understand that because she has been there over 3 years that by law I have to give her 90 days, He IS a MTM with only a rental contract. Doesn't spell out how much time I have to give her. I THINK the contract was drawn up before these laws of how long we must give a tenant that has been there for a while,..
So must I give her a formal written notice? (other than my email) i'm thinking to be sure I should send her a certified letter about it,..but I’m not sure I know how to word it,
I'm pretty sure she will fight it,..she doesn't want to move,..there is pretty much nothing available esp in her price range.
So again, if I send her a notice in a few days can I require it to be May 1st?

Consider contacting a landlords association where Google to find. It maybe time to start increasing rent. Most jurisdictions vacancy rates are at all low along with rental housing providers that had to fix vandalism where passed costs on vacant rental units. If she moves out then consider separating all or some of utilities where the tenant controls consumption and pays for what they use. Each province or state has a separate landlord and tenant act where the landlords association will be able to help with the process. Some places are making more difficult to evict. --68.69.xxx.xxx |

I don't believe the notice has to be certified, but it has to be in writing and lease or mtm you are at 90 days so may 1st is good, if you send it before the end of Jan. don't know if 28 days in Feb trips you up, lol. they might change the law by may. start thinking of things that are lease violations, so you have a good reason someday. can't speak to 'official' wording, but I don't think there is any. --172.58.xxx.xxx |

What does YOUR state LL/T laws say? In Oregon, you can NOT send notice by certified mail ( may cause a delay) Look up your state law and follow them to the T. Don't go by advice from someone that may or may not know their own state law.
