I have a clause in my lease that basically says "be nice" ... to me, my workers, the neighbors, etc" ... if you don't it's a violation of the lease and I will (and have) sent out reminders about it... keep it up and you will be out.
It's their choice at that point. Be nice or get out. I don't put up with that.
I've issued two warnings to two different tenants (in writing) and one on the phone (while the worker was there) and told that one that if she didn't stop being mean she can leave now... she's much better. Take control of the situation. --69.201.xx.xxx |

A relative and I owned a small apartment complex together. He and his family lived there so the managed the place and told the tenants they were the owners and I was the handyman/contractor who took care of problems.
Almost 2 years into the tenancy one tenant, husband and wife, complained about everything. There was no pleasing them. I'd make special trips, out of my way, to fix any little nothing. And I was getting sick of them. My partners took a vacation just to get away from them for some piece and quit.
So one day while my partners were still on their trip and the tenant was complaining about something, I got an idea.
I said, "Carl", you don't seem to be happy living here anymore, maybe it's time you think about moving"! He said, "I can't! I have a lease with 6 months to go"! I replied, "That's not a problem". I took out a sheet of paper and wrote down, "Carl and Linda XXX can move anytime from their apartment without the custom 30 days notice. Any un-used rent will be prorated and returned in full. No penalty for ending the lease early".
Signed Part owner, contractor and temporary manager.
The tenant did not move and changed his attitude and lived there another 5 years. When my partner came back from their trip, Carl was the nicest he's ever been. My partners asked what happened and I told them I gave Carl permission to break the lease and move...They were not happy about maybe loosing a tenant during a lease. But it was worth it. Each time Carl was not happy about something, he knew not to take it out on my partners anymore. --47.155.xx.xxx |

I have to say (without jinxing it I hope) that our folks are very good. We've had a lot of issues/problems since the first of the year and each time the people were really nice about the situations. One hadn't called me about the no water problem because they thought it was frozen! Mind you it was 32.
We've had one that complained about mold/mildew a few times, we've put on a new roof (that wasn't needed bad), gutters, and given her anti-mold absorbers. Then she'd ask for gravel for the drive, and started to be late some (would ask) then when I told her I was going to have to start charging her the 25.00 late fee, she started lying about it (was in the mail). I told my husband I knew she was lying because she didn't have the money to pay rent twice in one month! (she said we could keep the 1st one towards next months rent when it came lol of course it never did) So a tree fell during the 1st snow storm we had and she wanted it cleaned up before her new furniture came in a few days!
It was then I explained to her that our arrangement was no longer working for us. She immediately changed her attitude.

I flat out told one man that I was no longer putting up with his wife’s complaints, attitude or treatment of me and my contractors. That my contractor’s had indicated they no longer wished to deal with her and that doesn’t work for me.
So, if I had any more issues or attitude from her they would be given a 30 day noticed and be asked to move.

"Very abusive threats" are different than complaints, excessive requests, or non-cooperation.
If they have threatened to do you any physical harm, report it to police as well as give them notice to leave asap. Do NOT be in their presence without back-up, and then only if absolutely necessary. Do all communication in writing and remotely.

With a complainer tenant, I used the "Happy Clause" only once - you wouldn't believe how fast that tenant backpedaled and talked nice to me.
In other news, my multi-year, no drama tenant told us during a maintenance visit the other day that he had replaced a shower valve handle himself. The reason? "It broke on Christmas Day, and I wasn't going to bother you on a holiday weekend for a little thing like that, so I went out on Sunday morning and bought the replacement handle." (We're talking removing a screw, removing and replacing the handle, tightening the screw.) He has called several times over the years, and promptly, about leaks and other issues. We checked out the new handle, reimbursed him more than he spent for his trouble, and thanked our lucky stars that he shows no indications of moving on any time soon.

Happy clause is very effective. I've used it a few times. "Maybe this place isn't the best place for you. Maybe you'd be happier somewhere else. I'm more than happy to release you from your lease obligation. Just let me know". --70.92.xx.xx |
