Well, my target is to show that we are serious about getting paid. That maybe we don't have to go as far as an eviction,if he pays rt away. (not exactly telling him that) but putting a scare into him that in the future we will not fool around about be late.
I think he can well afford the rent, he has kept working at a pretty well paying job,..

If he still hasnt paid january rent i will assume you are going all the way to court so i would get on it now.I used to do my own evictions but NY has changed the laws in a manner i believe intentionally to help tenants get out of it,things like sending them a letter before anything telling them they owe rent,using colored papar at some point in the process to inform them of there rights etc,i cant keep up anymore. --72.231.xxx.xxx |

Depending on where you are I second Ken ... whether you think you want to go to court and actually seek eviction or not - start the process now!
Where I am, I use a Marshal service ... I pay them to serve the notice. It's a 14 Day notice to pay or quit now in NY (yes, 14 days). Today is the 20th so even if you do it today, you are now into February before they even have to pay or quit (aka leave).
Scare them the REAL way ... if they pay you before the 14 days are up in full, then you just drop it. If they don't, then you know the "scare" you wanted to do isn't going to work and at least you are ahead of the game and can move to the "lets set a court date" which may very well be May timeframe depending on where you are (I went down today and I'm not sure what court the guy was going to set up but they were already talking March dates). --69.201.xx.xxx |
