The Management company lost my HOA payment and now stating they will charge me a late fee if I do not process a stop payment at their expense in two weeks and provide another check payment. I feel they are out of order. Your thoughts. Thanks

Put yourself in their shoes. They are being quite reasonable... and correct.

I had a mortgage holder loose a payment check that I hand delivered to their offices. They lost my check and asked me to submit a new check and gave me $20 to cover my banks stop payment fee's. I got them a new check within a few days.

Then 6 years later while repainting their offices they found the lost check. I got a call from them. Unless I make good on this check, they are going to have their lawyer come after me.

I called and explained that they had lost that check and I re-submitted a replacement check with that in the "memo" section. They asked for immediate proof. I explained that I moved since issuing that check and I'd have to go to my storage garage and sift through my 200 boxes of records, it will take me around 30 days. They refused to wait and wanted payment now. I agreed that I was willing to give them half of the money so I'd not have to find my records of this transaction. They too could see they posted a full 12 mortgage payments that year. They refused and contacted their lawyers, who intern send me a nasty letter and sent a report to the credit reporting agencies. This made me mad and within a couple of hours I found my file with copies of all 13 check I made out for that year. The Stop Payment and a copy of the $20 payment with a note in their handwriting, "for a stop payment".

I gave this info to my attorney who wrote them a nasty letter. Either clean up my credit report and send my a written apology, or we are going to file a case with the banking commission about twisting a clients arm into making a double payment, or else!

Head rolled and people were fired at the mortgage company.

I got a verbal apology. The Credit agencies sent me a letter that things were taken care off because the report about a missed mortgage payment was incorrect.

Thank you everyone for your comments. Robert your example was why I was asking the question. There is some history with the HOA. He does not like when I ask questions because it may require him to something he is supposed to do per the Bylaws (newsletters, inspections, etc). There are a lot of homeowners that do not participate and some management companies would prefer that practice. He has made some rude comments or used unnecessary comments such as Jim’s (jerk). That’s unnecessary and never helps the situation. I never intended on not taking care of the payment. I just felt that people need to treat people with respect and it will go further. I read and appreciate everyone’s comments. Everything has been resolved. Thanks again everyone!!!
