This tenant is quite highly paid. But he refused to pay last month's rent after he gave 30 day notice, even with eviction possibility. Shall I evict him? And then go to the small claims court to force him to pay what he owes.

I would. He will then decide if it’s worth it to have an eviction on his record. I don’t put up with that nonsense, and there is no other way to guarantee he will actually move.

He owes the next months rent also. Your contract I feel pretty sure has wording that when giving notices rent can't be in arrears. All funds must be current for any notice to be legit. Notices are due 30 days prior or 30 days from when rent is normally paid.
So you have a tenant not current and attempting to skip out owing at least 1 month rent. He owes rent and since it wasn't proper notice he owe next month also.
Just like you follow the law tenants can't just up and withhold rent the last month.

Yes, you need to evict him. Two reasons:
1) Get him served NOW so you know where he is and the process server can get him before he runs off. Personal service is required to obtain a money judgment in many places.

Every tenant I have had move out has asked if they could use the 'security/cleaning deposit' as the last month's rent. Everyone was told "NO, it's clearly stated in the lease that this is not an option." The reason they want to use the security for the last month's rent is because they want to leave you with nothing in the 'pot' for you to do repairs/cleaning because they already used it up as last month's rent. Thereby forcing you to take them to small claims to try to collect for damages and repairs. Never a good idea since small claims is fun, but the likely hood you will recover even with a judgement in your favor is minimal. Get that last month's rent and hold onto the security to use as it was intended. My very last tenant actually paid the full last month due and I had the security/cleaning to use. That was great because his daughter was 2 days into the next month and I deducted for those extra days. (long story of nice dad vs. horrible daughter) Was so nice to finally be able to fix things and then return a bit to the tenant. I did file the eviction. But I had a typo in tenant's Unit number. Same typo mistake was made in the 10 day notice I served and posted on the tenant's door. Will the court require me to start the process anew? Or I can simply make an "addendum" to correct the typo?

Probably best to call the courthouse where your eviction cases are heard. I had s tenant who spelled his first name two ways. Transposed ae and ea. I was advised to put BOTH spellings on the paperwork. It went through with the 'aka'. Court clerk was very helpful in advising me. --174.65.xxx.xx |
