So far, failed water heater, motor on a furnace, plus the ongoing property line dispute on foreclosure we bought in 2013. Our attorney that handled it has suddenly retired, we have spoken to another attorney willing to take the case. We thought we had title insurance on it, but retiring attorney says no. We reminded him that we distinctly remember signing a disclosure paper saying he owned an interest in the company, which he vigorously denied. (How do you handle a situation like that?) It's possible I am confusing it with another foreclosure that we purchased through him, but I don't think so.
We spent 4,000.00 having a high roadside bank cut down and a new driveway installed on the other side of the property to avoid using the shared drive with relatives joining our property. New tenants are continuing to park on that side of the property, by driving over septic tank and around the back of house to access it because the porch opening to the front porch is on that side. (something else we need to do)
People are to lazy to walk across the front yard a little ways to go in the front door porch, but they could easily go ariund the back corner to back door.
Sorry, just venting. Have an appointment to talk to county zoning administrator to find out what we have to do to comply with current regs.
Previous owner installed a doublewide 56' long on a 125' wide lot, put it over the line to shorten distance to Mama's well! That was in '97, so past 15 years for adverse possession, unless it has to be for 15 years for each owner? IDK --71.219.xxx.xxx |

I think adverse says they had to knowingly be doing it,i doubt they knew it all those years so maybe the time clock only just started.
Af far as title goes,did you get a mortgage when you bought the place? if you did you most likely have a title policy.I would expect the answer from the attorney to be more like i cant find anything in the file showing you bought a title policy not just no and if he said no he confidently he hould provide a document showing you signed saying you didnt want a policy.Check your closing statement from when you bought it and see if you can find and title policy charges --72.231.xxx.xxx |

You say you may be confusing 2 different property's? Well that's on you. Do your homework and be sure your picking apples from your own tree--. Where are your closing doc's?
56/125ft? what's your county right of way? Or line distances?
I had something similar here in GA. lady said we built garage too close to property line. and was raising heck. Checked and measured and found out her driveway was in our yard-- not to close but in it. Pay back is heck.
PAT seems to me--- you need to get rid of the Jan 2022 blues and get back to your desk and kick some butt--- file a civil suit for damages against atty if you need to just to keep it open in the court. --99.103.xxx.xxx |

Pat, having been to trial court and a Judge ruling in my favor over adverse possession. It’s a long story but the 7 criteria that looks like adverse possession doesn’t always work in the court of law.
Find a good real estate attorney that is a trial attorney, this is the key to success when you are in the court room.
My case lady came over induced her self with a letter from a title company showing she had adverse possession. So, I took it to court, and came out better than what she expected. --174.202.xxx.xx |

We paid cash. There was a plat. Attorney said we didn't need a survey if there was a plat. (not true, cause we didn't know she had a singlewide there before the doublewide) We did check charges on settlement sheet, it seems like just a general charge for "title examination".
The county may have been partly at fault because obviously set back wasn't checked or the 25' from property line may not been in effect then but you certainly can't put one third of a house across the line!
Best case for us would be for the neighbor to agree to sell us what we need to comply at fair market value. That is our goal.
Yes, I'm sorry we didn't go sailing into 2022 worry free, but life isn't like that.
Worst case, we go to court & Judge says we have to move it. But, hey, I'm still looking on bright side, it's due for a new roof anyway, so we can do that after move. Then we can SELL it and get away from those crabby people. --71.219.xxx.xxx |

Meeting went well with zoning administrator. Due to the time frame it was done, she was inclined to let us get by with a minimum of distance but of course would like for us to see if we can get the 25'. She said the county maps are showing the doublewide in the middle of the lot, and questioned if the survey was done right?
I've sent for the serial number on the doublewide, I'm thinking maybe I should apply for a title for it with the DMV. It would be cheaper in the long run tax wise. It is not on a permanent foundation, thank goodness. Always something to be grateful for. --71.219.xxx.xxx |
