So a prospective tenant asked me a question after she filled out my application which by the way I did not charge an application fee for. Consider contacting a landlords association where google to find one. Make sure the deposit is legal within the landlord and tenant act or rules. More then likely she does not the funds for security deposit. Some jurisdictions do allow a cleaning, damage deposit where first and last only so be sure. Sometimes it is a motivation issue. Maybe late for now but was a thorough credit check where sometimes can find a few different addresses over a period of a year or unpaid utilities which immediately disqualifies. So if it is legal then state the policy where will have decide if she really wants the rental unit. Some rental housing providers learn from the hard school of knocks instead checking everything out. Found belonging to a landlords association where the cost was small compared learning to what can happen. Had one said she was to take me human rights tribunal as it was discrimination. She had a unpaid cable and cell phone bill for around $750 each. Told her that really wanted rental unit would have to make arrangements with social assistance where did not want to do that as the renege later. She never called back or took me to human rights. Another applicant refused where told they could reapply once they fixed the negative credit reports where doubt that was going to happen where they owed thousands. Was absolutely not prepared to hand keys through the gates of hell where it is rent arrears along with a completely trashed out rental unit. Seen some move into town then trash out every rental unit is town then move on where the free rent game is a never ending story. --99.236.xxx.xxx

I'd say that several of my past tenants or tenants of a friend did not bother to come back and clean up or haul away their junk because the deposit was so little they opted to leave a mess and forfeit their deposit. By charging enough, this gives a departing tenant the incentive to clean up after the tenancy is over. --47.155.xx.xxx

I head those questions off at the pass by stating up front that "Our Security Deposit is 2x the rent, the maximum allowed by law. We have found that tenants with more skin in the game tend to take much better care of the place! We don't make money on deposits, we make money by keeping our places rented. If we are able to refund you in FULL when you leave, we are very happy Landlords, because that means you returned it clean and undamaged. And in fact these days we refund about 99% of our deposits because we are choosy about who we rent to."

Is this the first time you've had a different amount for the rent and the security deposit, and therefore have not been asked the question before.

I am assuming that most of your competitors have the same amount for monthly rent and the security deposit. If so, the difference would stand out. Without any other clues, I would assume that this would be a natural question for someone to ask, and for the landlord to have a short prepared answere for.

However, demanding a different security deposit amount is a different story. You do not indicate that she did this. --98.122.xxx.xx

I’ve always said, when told “other landlords don’t charge so much”:

Well yes, rent is $900 and the deposit is $1200. A total of $2100 to move in.

Most other landlords charge 1st, last and one month security which in this case would be $900x3= $2700.

When rent increases we have to collect more to cover the last month at that time as well so we’ve found doing it this way, not charging last month but a higher deposit which is potentially fully refundable works better for us and our tenants. Any more questions? --24.96.xx.xxx

I arrive at my security deposit based on the tenants financial situation and credit history. If the rent is $2500 I use a $2600 or more deposit. Years or months later I don’t want the tenant believing they paid first months rent and last months rent and no security deposit.

I am with Jim OC....security deposit and rent are always different amount, with security deposit being more than last month's rent. Penna law allows an amount up to two months of rent to be held for security. I always specified that it was 2 months security, not security and last month's rent, and corrected tenants when they misstated it. My thought was why should I give permission to use half of my protection for the last month's rent, leaving me less protected for possible damage to the unit. I know, as a practical matter, if the tenant just goes ahead and uses security for last month's rent, there is little recourse, but why give permission?

Other landlords took a different approach. Penna. law also requires that after a year, landlords can only hold an amount equal to one month's rent for security. By calling half of the security "last month's rent," they avoided having to return it after a year. Not an issue for me. Only one tenant in 30 years has read the law and called me on it to return the second month of security.

Well, the Penna. courts have since ruled that calling half of the deposit "last month's rent" does not change the nature of it, and it counts as security. --73.141.xxx.xxx
