In a rental that was shared by several tenants, on a Month-To-Month lease, all tenants moved out except one entitled jerk! I tried everything to no avail. So I put on my thinking cap and read the original lease. It was a term lease that converted to a month-to-month tenancy with NO RESTRICTIONS ON RENT INCREASES.

So I sent the last Holdover Tenant an official letter with a Rent Increase Notice. It basically said, not words and not in the letter or form:

There were three of you splitting the rent three ways. $2,400 divided by three renters, that's $800 a piece. All responsible to play me the total rent. Now my new tenants who can't move in because you refuse to vacate, as agreed. The new tenants signed a lease starting out at $3,500 per month. Since you occupy the entire rental, you are going to be responsible to pay the rent in full, yourself.

Since I am raising the rent above 10%, this shall be your sixty day notice. Your rent is going up from $2,400 per month to $3,500 per month. You are still responsible to pay lasts months rent of $2,400 and the next two months at $2,400. Starting March 01, 2022, your new rent will be $3,500.

I will be filling a case in small claims court to recover all back rent, plus my legal fee's. You will have to take the day off to appear in court. I have your original application saying you make over $7,000 per month. So this new rent shouldn't be a problem. Plus you can try to sublet the other room, only with my written permission, an increased deposit and a full credit and background check.

Are you saying you didn't renew the lease-- did you send out a lease termination letter?

When we want a tenant out at the end of the lease we send out a NON-lease renewal letter. We don't go into details other than the lease end date followed by the condition of premises letter explaining what the property needs to look like when we get the keys.

When they don't move-- we file for a dispossessary with the court-- there's a line on the paper that says OTHER. Other is tenant is holding over beyond the term of the lease.

Quickest is probably cash for keys. Other than that, the only way to get a tenant out legally when they dig in and refuse to move is to evict them through the courts. Eviction might not be quick, depending upon your local court system. --76.178.xxx.xxx
