Arrrrggh I always thought you could get a MTM tenant out pretty easily,..not having even to give a reason. But the big problem PITA tenant doesn't want to move and vows to fight it tenant doesn;t want to leave and says going to cite very minor things wrong with the unit.
(However won't let anyone in to address them)

Landlords can terminate a month-to-month agreement without cause, yes. But that does not deprive a tenant of statutory defenses and counterclaims.
Anyone go through this and what happened with it? Were you successful? Did it take long?

Yes, I just went through this. I had a young woman on assistance, MTM. Assistance stopped and she started getting nasty when I asked for rent. Then her BF started trying to stay as the assistance stopped.
I filed for possession because of lease violations on July 1st. Couldn't file for non-payment as the moratorium was still in place until August.
Well, after going to court then going to mediation, she was forced to move on Nov. 19th. She had ample opportunity to submit an application for cera, but she was to lazy to do so. Even if I filed through cera they would not pay unless the tenant was involved. Now I am trying to serve her papers to go to small claims court.
So, I was successful but it took just under 5 months, 4 not paid, plus damages.

It took me seven months unpaid with damages, but if the tenant is vowing to refute this lease termination, and takes it to court, remind him it may effect his future rental prospects (for he will be looking as well). If he is paying rent now, you may opt to negotiate with with him a time frame to leave, maybe after the winter or early spring. --100.10.xx.xxx |

Beat them to the complaint dept. Call code enforcement and give them the details and tell them that the tenant will be calling to complain about non existent or trivial things and may deliberately sabatoge things. If they are reasonable (not tenant oriented) they may work with you when the complaints arrive.

Best advise is google to find a landlords association where the landlords association will provide legal help as evictions are not easy. As long as the rental unit or rental house has no serious building code or fire code violations then things should go through. In future it is better to run thorough credit checks on all adult applicants where can avoid passing the keys through the gates of hell. One out of three is problem tenant who is in the never ending eviction cycle. In the province of Ontario a credit score of seven hundred or above then if not they have to keep looking where now the number who pass out keys is getting smaller. --99.236.xxx.xxx |

If you really want to get rid of them, don't delay start TODAY, before they have a chance to actually contact your local BOH. Otherwise, your action could be considered retaliatory & they'll be there for at least 6 more months. As it currently stands, they could very well be allowed to stay there through February, March & possibly April if you don't get on top of this.
If you haven't already done so, either you or your lawyer should serve the tenants with a "Notice to Quit for Possession" (see MGL, Chapter 186, Section 12). We're already into December, and you must give them at least 30 days written notice, your notice would be for them to properly vacate & return possession to you by January 31, 2022. Since you're dealing with a real PIA, I'd be inclined to have this noticed served by the sheriff's department rather than a constable. I've found that tenants tend to take things a bit more seriously when a uniformed armed deputy comes calling.
FYI in MA whenever a LL wants to change the terms of an existing rental agreement the proper way to do it in accordance with MA law is to issue a notice to terminate the existing agreement with the proposed change in terms. When I've dealt with similar PIA tenants, I've included a proposed new MTM agreement with a substantial increase (minimum $500.00 but usually $1,000.00) in the rent. This way if they're not out on time I can at least get better compensated for having to deal with them.
THE KEY TAKEAWAY IS THAT YOU NEED TO ACT NOW BEFORE THEY GET THE BOH INVOLVED.

Steve beat me to it. His advice is exactly what I was going to say. I only do MTM and I have gotten PITAs out this way. Since it is a “ no fault” eviction, they will likely be granted a stay. Probably only 30 days. You do need to have the NTQ served ( or at least proof it is on its way to them) before they call the BOH. I get my places inspected by the BOH before a tenant moves in- that way I have proof there were no violations before they got there. --68.191.xx.xx |
