Tenant moved in for a week, claimed molds (invisible) make them sick, and want to be released from the lease. We agree to do that. Tenant asked us to draft up an agreement to terminate the lease. We want a release of liability for any future health-related issues. Have any LLs been in such situations and have languages I can borrow? Thank you.

Chris,

Been there. Easier to release and refund than pay attys to argue in court. What judge will not sympathize with allergies?

We each have different sensitivities.

‘Res agrees to hold Management harmless and to not post negative reviews or make negative comments to anyone.’

But first I examine if they just have buyers’ remorse, lying about allergies. If so they can pay the ELT and end the lease. Ask for their forwarding address and call that LL, ask when they signed.

My lease is clear: res has toured and examined the home and determined the property does not affect any allergies, asthma, etc.

Had an applicant try to rent from me with excellent credit, full move in funds and stellar references from previous landlords -- too good to be true. So I ran a full background check and it turns out they didn't list 1 previous address, a death trap of a rental, known for making people sick. This tenant was advised by their lawyer that their current landlord is going bankrupted and to "make money" they needed to find another apartment owned by a "rich" person right for the plucking!

From that day forward, I review possible medical claims and make my applicants/tenants fill out all of our State Mold, Lead Paint and Asbestos Disclosures/Information Statements. I also hand out the various Safety Booklets on the Subject in 1 of 12 languages -- so they can't say the didn't know.

Like scraping off the painted surfaces to expose questionable layers of paint from 60 years go. --47.155.xx.xxx

Life has no guarantees. Just let them out for free. Asap. The must vacate by XX three days. If it's bad for them they shouldn't stay any longer . When your in danger just leave, no early termination fee due, no 30 day notice needed, no sixty days needed to find another place. Leave quickly. --172.58.xxx.xx

I'm going through this right now with a tenant. Except she hasn't moved out after complaining about "deadly mold" almost two months ago. She's just declined to pay rent.

We've already been to court and I have received my judgment for an eviction. She has until the end of this month to vacate. I hope she does this as actual evictions slow down during the holiday season and it may very likely be January before this is scheduled. She also has a good amount of "stuff" in the property (which made it difficult to do an inspection after receiving this information) and I'm getting tired of hauling tenant garbage to the street. --73.108.xxx.xxx
