I'm a Landlord, my tenant is working yet collecting unemployment and Medicaid, I'm sure fraudulently. He has not filed for rental assistance (called NY state to confirm) My attorney says discovery and subpoenas would drag it out too long and be costly to evict on this basis. He has not paid me since he beginning of 2021 and makes every excuse in the book and is close to 10k behind in rent.

Isn't there a clause that states one can remove their tenant if they are moving back into their property? Any prepared notices to do this? or just write the letter and give them 30 days? How long must you occupy (live in) property before can re-rent?

Wouldn't this be the easiest way to go about it?

Where are you located? most of the state is doing evictions for non payment of rent.Find a different attorney,in every community there is a lawyer who does lots of evictions,go find that guy --72.231.xxx.xxx

Can't you file for possession?

I was on zoom today, which is online for our cases to be heard. No in person court anymore.

There was a case before mine and that person filed for possession based on no rent paid.

The LL asked for possession. When the tenant was asked if he could pay what was owed he said he could not and the LL asked for the judge to order him out in 10 days. The tenant agreed to move within that time. If he had not of agreed the judge would have ordered it.

Now the LL needs to file for a money judgement for the amount owed as well as any charges after the move out.

I did the same thing, asking for possession, but because of lease violations. (I filed before the M was lifted)My case went to mediation where we agreed on stipulations.

My tenant moved out Nov. 20th and now I also need to file for a money judgement. --67.22.x.xx

Do you know where the tenant is working? You can now challenge covid hardships in eviction court. It's NYS so they don't care about UIB and medicaid fraud but you can try and blow the tenant in for fraud.

You can also call your local representative. I had to do that b/c my tenant filed for ERAP but put in two applications which is delaying everything. Ask about how you can get ERAP for their "covid hardship." (TM) --72.231.xxx.xx

if your tenant has been there more then 1 year it takes more then 30 days even if you now have mtm tenancy. no need to go through the b s of what you propose. file a money judgement and termination of tenancy. sounds like you need to hire a process server and find a new lawyer. the tenant has to be presented w the hardship form. the process server will serve that and document it along w the other notices for the proceedings. --172.58.xxx.xx

For those that don’t know, NYS has a moratorium until Jan 15th, can’t kick out due to non-payment .Evan if their lease ran out which is the case in this case- essentially allowing tenants to squat so we pay their living expenses. My tenant won’t apply for ERAP- rental assistance either. I understand that I may be able to if funds are still available. Am I living in the twilight zone? --107.77.xxx.xx
