I have a restraining order against at tenant. She has texted me a few times in addition to a phone call. The order states she is not to contact me electronically. In front of other tenants she also threatened to burn down my building. I live 4 hours from the property. An eviction has been filed and I'm awaiting a court date.
My question: how do I go back in front on judge for violation of the order? I have made a police report with my local PD who will forward to the PD where th property is located.

When I had a problem like yours I asked for help from my other tenants. When the problem tenant made idol threats, I asked my tenants that over heard the conversation to write it down and date it. Then when enough of my tenants were reliable witnesses, I drove them all to my local police department and filed a report, making the officer taking my report to put down my witness statements and their contact information. I got a case number. Then I followed up this report with the police investigator assigned to my case.
Then I handed all of this information to my attorney, who then filed for the eviction and filed for a restraining order to remove the threating tenant from the rental property. Lucky for me on that tenants application they listed Parents living close by and a sibling living around 10 miles away. So when the retraining order got served onto the trouble tenant, they filed and came to a hearing. At their hearing the tenant complained they had no place to live and didn't deny they said some pretty mean things. But the judge had the information that family was close by so the restraining order stood and the judge let the eviction case decide the fait of the tenants future at the property. --47.155.xx.xxx |

It has been many years since I have done this, but there is a computer registry in CA for restraining orders, called CLETS. It might not be available for your situation -- it might be domestic violence only. But once the restraining order is registered, the cops can access it and enforce it. --76.4.xxx.xxx |
