Anyone have luck doing this? What are ways to get them to tell you where they work? Can you subpoena that? can the court make them tell you? I have not sued a tenant in over 10 years - never had much luck collecting. --76.189.xxx.xxx

In MA we can not serve the tennie at work ... so collecting becomes a game of "hide n'seek". They win EVERY TIME. I haven't collected on a judgement in 30 years.

Most states have some provision for requiring a judgement debtor to disclose assets.

In CA, the court can require the debtor to appear at a court hearing where the debtor is required to answer questions under oath regarding his assets.

There are more ways to garnish or get your money. Each state is different so I can only speak for our state and what they allow.

Tenant skipped and caused 10K in damages. Left a whole house (20 yd dumpster + pickup truck load for us to gather and dispose of. Along with damages-- she owed rent.

My collection person back in 18) said he read that this same person was going to close on a new house (ON FACEBOOK).

WHAT DO YOU NEED FOR CLOSING?---- C A S H!!!!!!

We checked his & her file but decided to "blanket 20 banks with our judgement---- WHIM WHAM thank you man-- found 8,500.00 in a credit union. They had the judgments and sent us the $8,500.00. B of A had 1.50 in an account we told them to keep it.

In Penna., L-T judgments are the only type of judgment that can garnish wages. Even then, from what I have learned, the courts disfavor it and will void your attempt if it is not written up 100% perfectly. Okay, after I've evicted a tenant and converted the eviction to a "Money Judgement", I wait 6 months so the tenant can't appeal the award.

Then I ask the courts for a debtor's exam. I ask the tenant to bring with them everything: tax return, bank accounts, pay stubs, auto registration and more. The tenant will show up with almost nothing. So I ask the judge to force the tenant to provide this information. The judge will order my tenant to provide me with requested documents.

The tenant thinking he so smart because I can only conduct two debtor's exam per year decides to ignore my requests.

So when my tenant is a no show to provide the ordered documents, I have the judge issue a bench warrant. This means if my tenant is stopped for any reason, they will be arrested.

This teaches a tenant not to ignore my requests. --47.155.xx.xxx

Good stuff. I have had almost no luck collecting, I even had tenants get credit reporting agencies to show a debt was (to me) paid that was not paid! Liens on property, nothing ever worked. Garnishment, they quit their job.

Yes, I have had good luck doing this. If you already have a judgement you can garnish wages, in Mi.

The trick is to find where they work. I ask friends, my friends and whoever I think may be their friends, where they work or live. I act like I am one of their long lost friends trying to reconnect with them. I also check and recheck facebook, etc. for any info. I have even followed one person, who I had trouble catching, after viewing that person shopping at Walmart. I sat in the parking lot, waited till they came out and followed them, making sure they unloaded groceries at that residence. I then went back and followed them to work.

When I do find out where they work I fill in the required paperwork and send it to their workplace. I have collected all that was owed me on 4 different past tenants.

Was it worth the trouble? Yes, as between all 4 they owed me over 6 grand. --67.22.x.xx

The one and only tenant I've had to collect on, I turned over to the Mr.LL collection services. She knew how to game the court system to avoid garnishment, etc. so my efforts didn't work. With the collection agency, it took several months, but she paid! --174.96.xx.xxx

you don't take applicants who have not been on the job long. They gotta be vested.

We don't give a hoot what that score is-- if they have a job they've been at a long time-- THEY AIN'T QUIT'IN IT. Examine their pay stubs and C/report to be sure no one is currently garnishing them-- so if you garnish your first in line with your hand out. It will show on their pay check and C/R.

I feel for you in states with no alternative to people screwing you. Politicians must have someway to do it?

DonV, pay close attention to the advice given by myob. Learning to collect on judgements has improved my screening immensely. I donít go to court nearly as frequently as I did 7 years ago when myobís posts challenged me to learn.

While we all look to outsource certain tasks, I believe that every LL should be expert at garnishment, bank account seizure in order to properly assess risks.

Just had a garnishment filed yesterday. First I had to get a court judgment for the money due from rent and damages. That meant one of the two had to be served papers. The guy posted on Facebook where he worked. I hired a lawyer to serve him papers. Court date set. He doesn't show. Received my judgment. There is a way in my state to file the judgement with the court and I printed off the paper but was missing a key element. So I turned the judgement over to a collection firm. Read yesterday they are garnishing. I will share any money collected but I am also not doin the work involved. This is my third one that this form has collected. I have two more, still waiting to find out where I can get papers served for those. Considering a skip tracer. --172.58.xxx.xx

In all Honesty-- your not going to collect every cent but that's not really the point is it? The point is: I'm not letting anyone walk and trash my beautiful property and own me money for rent--- even if I lose money on the deal--- or break even I DON'T CARE. The money judgment is good don't get me wrong. The judgment on their CR or they have to declare BK--- don't care either.

However I did have a really great private process server who works on holidays and who was essential in helping me serve the teacher. Her principal kept telling the sheriff's who were trying to serve her at school, that she wasn't at work-she taught high school from 8am-4:30pm. What a joke. Illinois is hard to serve former tenants and are more lenient with tenants who owe monies. Make sure you get there license plates number, vin number, as well. Every court is a little different but in OH if you have a judgement and if they make enough money it is relatively easy process to garnish their employer. In my area service is done by the court and can be as good as you checking the box for service by mail for an extra $5.00.

You fill out a few forms, pay fees and get a judgement debtor exam. If they don't show you can even request a body attachment and they can be arrested at some point and forced to show up at court. Check the court of clerks page for more information. The hardest part is if they change jobs you have to go back and do it again because your garnishment is only applicable to that employer. --72.49.xxx.xxx

In Oklahoma we can have the judge sign a document stating t the defendant has a judgement against them. The signed document goes to the Oklahoma Employment Security Commission to release who they are receiving wages from.

I accidently found a previous tenant with a judgement when my email contacts merged to my LinkedIn account and it pulled up two people that owed me money. They were keeping their LinkedIn account up-to-date and I verified they still worked there by employment verification and "bang" got a garnishment started. When the renter is still in the rental the BK court will instruct them to continue to pay rent. If they don't you can partition the BK court and they will either make them pay or boot them off the BK for not following the trustee instruction. Once booted off they are no longer protected-- bam you go after them again as does everyone else they owe.

If they are not your tenant any longer-- you ain't gettin diddle! your considered a NON SECURED DEBTOR and your sunk. HOWEVER if they get booted off BK protection your back in. We have had many-- most violate the requirement to file income taxes. We have an internet program for finding out about BK cases. (think there's a fee for that)

recently we had this happen-- 2yrs ago. Tenant filed BK but never told the court she was renting. When we didn't get rent we called her and she advised us she was in BK-- so now we couldn't contact her. We called out BK atty and it took 5 weeks to get a hearing to lift the BK stay. Then another month to get here out. Total cost was over 5K. But facts are facts-- we had to process otherwise she'd still be in there. Nothing was done for her CONTIOUS OMMISSION OF HER RENT. WHY? cause the judge would have told her she still needed to pay rent. When she listed her obligation and SWORE TO THEM -- she never put rent on her sworn affidavit --don't you think her BK atty knew she was renting? or THE TRUSTEE SHOULD HAVE QUESTIONED? NO! THEY DIDN'T. So the whole system is filled with liars and cheats. --99.103.xxx.xxx

Would anyone be able to recommend a collection agency / attorney that will file wage garnishments in PA?

Like many LLs - we go thru the motions of obtaining judgments and reporting debt to The Mr. Landlord Debt Collection Service but, never collected anything.

As someone mentioned above, with so many LLs owed so much money, wage garnishments could be a very profitable business. While debt collection requires cash in a debtor hands, wage garnishments only require a debtor to have a job.

Am I missing something?

Yes Scott. one big item. unless your an attorney you can't collect debt for others here in GA. You can do all your own court stuff when the debt is yours.

I've often thought about this as a second business.

This thread has more useful info then I have learned here in over 3 years. THANK YOU, MYOB great point that learning collections helps with screening. Never occurred to me to check pay stubs for other garnishments. Also long term employment. Trying to figure all this out takes a lot of my valuable time. Not being able to transfer that knowledge to the net court doesn't help. That said I think this is time well spent and plan to learn more.

THE BIG QUESTION.......... my properties are in an LLC???? Does a lawyer need to do it all? So far I have always been able to get my evictions (I have only had a few) but going further into debtors exams and garnishment? Years ago in Ohio I filed for a debtors exam, they ignored it, there was nothing I could do and they did not get into any trouble. --76.189.xxx.xxx

What good do license plates numbers do? Where can you find info? I would happily pay 25% of money collected to someone. I have tried a half dozen places, wasted my time filling out paperwork and sending them info and not a single one ever collected a penny. All came "recommended" no random calls. Sme were college kids who graduated, and parents cosigned. No one could collect (a half dozen of those). This has to be a "best case scenario" Ridiculous. --76.189.xxx.xxx

DonV, in the eyes of a collection agency, a rent collection is the worst type. Too much work, too little pay. Consequently, they make a quick try based on the information contained on the application that you required of the tenant. If they don't immediately get positive results....they quit.

I wonder how easy some of the better collection work must be in order to be of interest to the agency.

You have been advised to learn this yourself. You will hit a few bumps along the way and emerge with useful knowledge and money.

After you have become expert in collections, you may look into hiring an office assistant to fill in the forms and file them.

You NEED to develop people finding networks (independent process servers and Sheriff Deputies have been helpful for me). Enjoy your new hobby!
