On Oct 22 Indiana Supreme Court now requires judges, starting Nov 1, to ask parties in an eviction case if they want to participate in a Diversion Program (mediation outside court with a third party). IF both parties say yes, the LL agrees to not evict for 90 days

AND

the case is removed from public record so the next poor LL does not know his applicant is being evicted.

I fear Mom&Pops will believe the res will pay up (we all know they don't!) and lose another 90 days plus 2 weeks to get back on the court calendar and 3 weeks free rent from the judge. That's 4.5 months of lost rent.

Another reminder: courts will shut down for a week over Thanksgiving and more time in December.

FILE NOW or your case may be pushed into January!

October is CLEAN HOUSE month.

On the bright side, other people's poor decisions mean opportunities for people who make good decisions. It wouldn't be this way in the ideal world where everyone acted honorably, but such is not reality.

George Clason's book "The Richest Man in Babylon" says one of the 5 Rules of Gold is (paraphrase): Gold flees from the hand of one who does not know how to manage it and finds its way into the hand of the one who does.

Know the rules and follow them or don't be in the game....you'll get hurt!

What happens with mediation is it simply puts off a eviction where they always default on rental payments then end with more rent arrears so end getting evicted. Had a eviction drag out for year where they claimed they were being harassed for rent for rent where they put a stay on the sheriffs order. They never showed up before a judge where finally once and for all had everything down in text where one word was about rent. If they lived in government owned rental unit end of story no rent then out. --99.236.xxx.xxx

Times are changing.

To me, mediation is a joke. They will most likely not pay. If they were people who paid and kept there word, they wouldn't even be in court. Just another way to delay the process and teach the irresponsible that it is okay to be irresponsible. Just like BK.

Our court ordered mediation for damage hearings in small claims court about 5 years ago. The small claims office clerks tried to run it and were obviously not trained. It did not last long as I suspect some persons got violent. --216.23.xxx.xx

I attended Mediation. The tenant was on assistance, so it was myself, the mediator and the case worker trying to agree.

The DB tenant was on her phone, as required, but it was the case worker who I had to work with.

I was not asked if I wanted to mediate, the judge ordered it.

The case worker told some lies but that didn't count as she believed what the tenant said. That woman tenant deserves a gold star as she is a master manipulator. She reminds me of a queen bee as she has her case worker, an attorney, the foster parents of her kid and other possible adoptive parents all going/driving to her location, all buzzing around her to do her bidding.

She recently had twins, and agreed to let them be adopted but we have learned (not formally, but through the grapevine) that she won't let them go as she wants more money. I believe that is called human trafficking.
