Never had this happen in 20+ years of rentals. Tenants, Ma, Pa and about 7 year old kid, agreed in court to vacate. Didn’t vacate. Sheriff put 48 hour notice on door Thurs evening. So had to be out Sat evening. I was out of town, no notice to me. Stopped by on Sunday around noon, noticed them still there, slowly packing. Called sheriff, said they couldn’t get back out until Monday. That seemed too long. I informed the tenants they were trespassing, but could continue to load their Stuff until 4:00 when I was going to return and change the locks and asked they be gone by then. Stopped by after 4:00, they are still there. While they plodded along, I changed the locks, and told them it was time to go. They asked for more time. I said no, time to go. Their kid crying and getting his juice boxes from the fridge. Maybe the most awkward situation in my life and not the greatest as far as personal safety but they gave no trouble. Slapped the “No Trespassing” signs on the doors and left them standing in in the yard. They remained in the driveway in their vehicles for over an hour before departing. Probably calling for a place to spend the night.

I feel your frustration and think it very nice of you to give them more time, until 4:00.

It takes some people longer to learn than others and they may be procrastinators.

I know it is a hard lesson but hopefully these people have learned something from loosing the home they lived in.

They probably had months to do something and chose not to.

It is hard for you, but you must go on and do the best you can.

The saying comes to mind- "You can lead a horse to water, but you cannot make it drink."

This is a prime example for the tenants. Life goes on. --67.22.x.xx

JR ME so in ME the sheriff doesn't supervise the eviction?

Our state the sheriff is scheduled to execute the Writ of Possession. Only the sheriff can supervise-- even though its us doing the set out-- he signs off on it when we do the last stick of stuff. We then place a notice on the door that anyone caught inside will be prosecuted for B and E and arressted.

What you did in our state is considered a self help eviction and is illegal for the owner to do. --99.103.xxx.xxx

Here, you couldn't do that yourself. The constable must officially follow through and 'put them out' before we can change the locks if they haven't returned possession. Here, it's a 8-4 job Mondays through Fridays.

That said, they don't get 48 hours, they get 11 days. --98.237.xxx.xx

As the constable told my last eviction who asked for extra time stating the 10 days wasn't enough, "It's not really day 11. Your notice has been since the day your rent wasn't timely paid". --98.237.xxx.xx

Here in Los Angeles if the tenants don't show up in court for the eviction, then the Judge has their Clerk call the tenants and explain, they can make up a Covid-19 excuse and then their case can be dropped. --47.155.xx.xxx

In Maine, the Sheriff doesn’t come back (at least around here) after the 48 hours are up unless called, and the tenancy ends 48 hours after the writ is presented and plain letter of the law says landlord can change locks and if tenants remain they are trespassing. --98.13.xx.xxx

MYOB, also, the Sheriff around here doesn’t supervise the move out, etc. They slap the writ of possession on the door, and if the tenants are still there 48 hours later, will return and remove them. That’s it. --98.13.xx.xxx

I like the way the UK does it with a high court writ. They get an hour to pack their essential crap, get out and the locks get changed. WHO RETURNS? the sheriff? This is where it's confusing. So he didn't return maybe because they don't work weekends? -- so was he coming back Monday? the first business day.

I just seems a shooting waiting to happen. Our Sheriff has his hand on his gun at all times when serving these warrants. We stay back until he gives the all clear.

I always request the sheriff remove the tenant-- they have had enough time to pack-- they can now get their family airlums from the curb. --99.103.xxx.xxx

What MYOB said. You did not want to wait for the sheriff to come back and remove them so you changed the locks. So you are allowed to do that rather than wait? In Penna. the sheriff serves a first writ of eviction, which is really in effect a warning, on the tenant. After 11 days, the landlord can file for the second writ (assuming they have not vacated). The sheriff then comes and serves the second writ and gives them 15 minutes to grab what they can and leave. If I were to do anything myself before that second visit by the sheriff, it would be self-help and a $300 per day fine. --73.141.xxx.xxx

My one and only eviction in San Diego: 2 Sheriff Deputies arrived with no notice to Tenant. Only told me and made me promise to to 'spoil the surprise'. Went to house with me, instructed me to stand outside while they cleared the house. Found the 17 year old son only alone. Asked him to step outside, and 'cleared' the house room by room, yelling 'clear' each time. Just like on TV. Fun. Stood by while I changed the locks and put the notice on the doors, and gave me one to sign. Told me and the 'kid' that if anyone attempted to re-enter the house by any means, that I (Landlord) would be calling 911 and arrests would be made. Anything left inside (lots) would stay until I decided to release it to the former Tenant and to NOT allow the Tenant or anyone into the now locked house no matter what. I had to empty one room where she had stored all her 'important' stuff. Moved it to the patio and notified her she had 15 days to collect it. Was easy once the whole thing was finished.
