WOO! The cases are still out there folks. Here's the scoop.

You file for non pay-- it sits for weeks (this goes for tenants holding over also) until the court asks you questions-- will you need the judge?, will you do mediation?, will you agree to any meditation agreement the mediator presents? --- folks you haven't seen the judge yet and this goes on for weeks.

We had 2 cases-- one the deadbeat army guy finally moved out after 10 days on the dispo -- moved to MI. Good ridden. His co-occupant- girl friend left a few weeks earlier because she had enough of his BS. We have left that case open as a dry run to see how long this crap would go on. Sept 6 we filled with the court-- and still no hearing. Tenant answered the last day they could to extend it out.

Second case is C-19 claim. We have tried everything to get it in front of the mediator-- nada nothing. You can't get to the judge without the mediator (yes that's right the mediators are now deciding cases not judges.)

Sept case was filed -- nothing. So we get our mouth piece involved-- he can't do anything either. We figured hey this moratorium is over-- but that doesn't mean these a- hole judges are working. They have let the power hungry mediators (who are jerks and always have been) run rough shod over the LL's.

On paper it's over but they are dry walking all the cases-- yes dry walking from last year. The dead beat army guy is gone and house is re-rented. C-19 people -- well we know he took a PPP loan for 20K for his barber business that was closed. He brought a 80K dodge and a motorcycle-- and guess what? he almost got killed on the cycle-- that's why they can't pay-- but they lied on the court answer-- we have no way to get this to the judge and we're just fuming. I was wondering the same thing,...where is the massive tsunami of moratorium based evictions? It would be front page news if it was actually happening. I will have to assume there a lot of LLs out there who don't seem to mind getting stiffed on rent for 12-18 months. --68.63.xxx.xxx

Come to find out, the majority of tenants have been paying and have not been taking advantage of the situation. That and the eeeeeeeeeeevvvvvvviiiiiiilll landlords would rather not go through the time, hassle and expense to evict someone who has been doing their best to pay the rent.

Bad tenants will always be bad tenants. A leopard cannot change its spots.

I served my first Notice to Pay since the Covid panic shutdown in April 2021. We had the hearing about 4 weeks later. The Judge granted a continuance to the Tenant that exceeded the Judge's legal authority, but I was not going to challenge her. The eviction order was issued ten weeks after the Notice was served.

The Court docket was not crowded, there were about 15 cases set for hearing the day I was there. Pre-panic, there would usually have been about 30 cases per day.

The wave would be there if we could get the courts open-- in GA anyway. We drive neighborhoods all the time and have seen-- with our own eye's maybe 4 set outs by the Sheriff. There's 30,000 cases pending in the clerks office.

My manager checks the court records and see's such and such case determined and Writ of Possession issued from a case from April 2021. This is October!!!!!

6X-- the C19 tenant texted us. The insurance check is coming next week-- from the motorcycle wreck and they want to know how much is owed. We originated a consent-- it had 4K owed with all accrued expenses, had Nov and Dec amounts and dates they need to be paid. They signed the consent. It's at least something.

FYI if I get a consent signed (outside of court) we bring it to the clerk-- they give it to the judge to sign. No court room appearance needed. WHAM your now golden...

No tsunami here. We have been evicting for well over a year (except Harrisburg and Philadelphia). Courts, unlike myob's area, are following the standards which means your hearing is within 7 - 15 days of filing the complaint and none of the mediation, ...next.... hearings are scheduled every 5 minutes. --98.237.xxx.xx

I'm in Pickens County, GA. Stopped by the Magistrate office at the week after the illegal moratorium was lifted and asked if they were overwhelmed with evictions. The clerk said it's business as usual and she hasn't sen any uptick in evictions. --172.102.xxx.xx

I receive local court calendars every day. I quickly searched through a few local counties and didn't find one summary ejectment (eviction) except in connection with a divorce. In fact, though, I found a BUNCH of divorces. I don't know if this is typical, never having looked before, but it did stand out. --108.4.x.xxx

The government funded reactionary tenancy advocates groups said this was going to happen when the majority of tenants were able to pay rent where they thought this free for all was going to go on forever. Now is the time for economic recovery where rental housing providers can start to spent money in renovations along with improving energy efficiency in the rental units to minimized green house gases. The media does understand that reactionary nut cases do not even represent 0.01 per cent of the population. There is not enough money in the provincial treasury to buy out all the rental buildings and houses so where is money going to come from definitely not them where they will not sell the houses they own. Bob that statement may be true no uptick-- but have they been having court on NEW cases.

I've found there aren't really new case but a backlog-- because court was closed a year of old cases. I think we all agree the same people haven't paid-- your tenants who are good remained good from the beginning. So the fact is the cases were filed 12 months ago and are still sitting out there. Since they've been filed on and the LL is waiting-- no new case is needed. --99.103.xxx.xxx
