Most Cities or Stats do not allow a landlord to refuse a section 8 tenant, but they can be screened and turned down for many reasons. I require a tenant to have a 6 months reserve on their share of the rent. This guy only have $20, for his daily cigarette purchases. He would not save up $1000 in the bank to cover his share for 5 months worth...Denied. --47.155.xx.xxx

I require applicants to have the means to cover 4 to 6 months worth of expenses in savings or a combination of assets such as a pension fund that they can borrow against.

Think about this. The average rent for a 1 bedroom apartment is around $1,200 a month. So If my applicant doesn't have between $5,000 go $10,000 in savings, then if there's a hiccup such as:

Vehicle broken needs a major repair

Injured playing sports and unable to work for 2 months

Catches the flue and is bed ridden for a month

Gets laid off and takes a couple of months to find a new job

Then will your tenant move back in with their parents, borrow against a credit card or simply stop paying your rent?

I want people that have the means to cover the basics....

Yes at one time I had units in Boyle Heights, South Central and other shady areas. Landlord didn't expect much in the way of earnings, savings or the ability to do better for their family (kids). When my tenant Donald purchased a used Jaguar XJ6 instead of supporting his 4 kids and wife, I knew that in a short while there would be an eviction.

Unlike my tenant Albert who sold his vehicle and took the bus to work, so cut down on expenses so his kids and wife could have what they needed.... --47.155.xx.xxx

Better know your federal,state and local law. Some do have the requirement that you can not discriminate due to source of income (rent payment). You can reject for other reasons as long as you are consistent (apply it to everyone). I have a really GREAT tenant that is on section 8, and one that is a good tenant. I have also had some real losers on section 8. Same thing for non-section 8. Screening is the key for both. One of the things you can do if they have been on section 8 is to request a history of complaints / issues from section 8 on the applicant.

If you just say "NO" and there is a law where you have your rental- be prepared to get sued. --73.11.xx.xx

In California we must count S-8. I require a 700 FICO, 3 years on the job or $15,000 in back up savings and maximum debt 50% of one years rent excluding student loans or medical bills. My last 2 applicants sold their homes and had over $150,000 in the bank.

Problem solved for now.

I just say, "I accept S8 but they don't accept me. They require a 1 year lease to start and I only do Month to Month (Tenant at Will)".

Another option is to say "This apartment is not approved for S8".

Yep that will get you in trouble here in NY. Source of income is a "protected class" now.

Some S8 tenants do work just enough to keep from getting their subsidy cut off so they would pay a share of the rent which they usually don't do. I think that is why McClean? of S8 Bible only wants S8 tenants who are also on Social Services so that all the rent goes to him. --174.208.xx.xxx

So far that has kept them all away.

I used to say, sorry the house isn't approved by Section 8, but in Oregon they passed a law that says if the house can't meet the Section 8 inspection, then the landlord must upgrade until the house can pass the Section 8 inspection. --76.178.xxx.xxx

What Oregon Woodsmoke said is the best response. Here in Philly we cannot refuse Sec 8 because the City has a law against discriminating by source of income and the Administration considers sec 8 to simply be a source of income. Of course, that is BS. It is not just a source of income, it is a program with a poorly run bureaucracy that you must deal with, and inspections that go beyond city code requirements. However, more efficient to use Oregon Woodsmoke's strategy than to spend $50k litigating the validity of the Administration's position. --73.141.xxx.xxx
