Following a court ordered warrant of removal, how many days does the landlord have to remove the tenants belongings?

Have read that after 3 days the landlord can throw away and also read that the landlord has to store for 30 days.

Any information is appreciated.

in GA the belongings are placed 10 ft from the curb. The CODE enforcement people follow the sheriff and when the set out is done-- they write us a ticket for the trash----- don't ya love it.

I've confronted these Iditols about this-- your sitting there watching the set out and 5 minutes later you writ us a summons for trash-- yea and I'll support you next time tooo.

One time they (code enforcement) called the regular police on me. Evicted tenant was throwing stuff he didn't want back up to the houses. OH! and YES the cops told ME to stop or be arrested. He continued to kick and throw stuff at house and I had to stand there. --99.103.xxx.xxx

This is absolutely state specific. You must store the stuff and send a letter via certified and regular mail - offering 33 days from the date the letter is mailed. You cannot hold the belongings for ransom for money owed - BUT you can charge for reasonable storage and handling costs and demand these fees in cash or certified funds before releasing the belongings.

Here's a model letter to be sent:

October 22, 2021

from me

to tenant

re: things left behind

Dear tenant,

You left a lot of personal effects behind. If you want any of these things you have 33 days from the date of this letter to contact me and retrieve your things.

You must also pay reasonable storage and handling fees by cash or certified funds at time of pick-up. You will also need boxes, handcarts, and help to remove your belongings.

If you don't retrieve your things within 33 days, this property becomes mine and I will dispose of all of it and bill you for my time and storage fees.

This letter was sent to you via regular and certified mail, return receipt requested.

Very truly yours,

Three separate. What is rotting needs to go to garbage right away. What is usable can be donated to charities and what is broken unusable needs to go to the dump. So in the end it is worthwhile to donate to charities which can use those things. Here some people on social assistance get funds so they leave everything behind. That is not good for the environment as most winds up in the landfill dump. --99.236.xxx.xxx

No! the wording should be the items you left appear to be household trash. Don't mention they have to pay cash-- I was put in jail one time because the judge said I held the tenants "STUFF" using a ransom to retrieve items.

TONY your letter sucks-- forget that wording.

Like your property becomes mine? No no no. Your property is considered abandoned and will be disposed of accordingly.

myob - there you go again - posting and craving a reaction.

Here goes.

The letter I posted was composed by a New Jersey attorney and addresses specifics resulting from New Jersey case law. Sorry you don't agree with it, think it needs editing, and think it sucks.

I personally would change the sentence cause lawyers find it easier to keep a client rather than invent a new one. I would want no reference that anything left had any value. But I live in another state. --172.58.xxx.xxx

Tony of course-- reaction. Thats exactly why I post here. I love people like you claiming to have it wrritten and its the cat's meow. Tony I've been to court the past 45 years 100's of times. You write a letter like this and some bleedingheart judge will dash your hopes. CRAVING not so much --

I do love making people think and respond AS YOU HAVE. I really don't care who put it together-- its terrible misleading. I told you what I think and just because some attorney YOU PAID wrote it means nothing to me-- and frankly case law does not support a judges thinking. But Tony it still sucks and you are espousing others use it... my opinion. OH and Tony fire that attorney!!! just saying. --99.103.xxx.xxx
