We have owned this property for a long time, in fact, it was my husband's mother's house. It is now vacant and I am running an ad in CL & FB. Surprised by a request from one of my current tenants today. Her mother (whom we've known for years, she used to work for my husband) wants to give up her now public school teacher job and start a daycare & wants to know if we will rent her the house for that purpose? In the recent past, we have always said no, however, this same house was used as a beauty shop for a while, before we knew better.

Even if we wanted to, and I stressed to her that as I see it we have two main obstacles:

1. Liability issues/insurance

2. Sex offender lives next door (Tier III)

Granted it was years ago, & with his own child. Plus he is 72 years old now, but hey, we are in our 70's, so I won't go there!

I have pulled up the sex offender requirements and the way I'm reading it, he can't live within 500' of a daycare facility so the whole question is a moot point. --71.219.xxx.xxx

This is the kind of thing you run into renting property in a small rural community. The lady that asked me has been renting from us for over 7 years. Her mother (the teacher) worked for my husband in the office when he was a plant manager 25 years ago and her husband also worked for my husband at the same plant. So you have to understand, this is coming from them as having a "dream" come true, instead of being practical.

I would hate to see her give up her good benefits as a county employee and then heaven forbid it not work out well for her. We can always rent it, have never had any trouble renting it, even with the guy next door.

I'm not worried about telling her no and why. Just throwing it out there for discussion. I'm not about to allow it unpermitted and that's not going to happen. They probably will think I'm being difficult/unreasonable about not letting them do it "under the table". But, we have had to say no to other tenants that proposed running a business out of our rental, & we need to treat everyone the same.

Just trying to get her to see why we can't do it, so she won't hold it against us.

Jason, that is a good question. Since he owns the property, I wouldn't think so and that is why she'd never be able to get it approved, even with a request for a zoning change, if it was needed.

A guy in the neighborhood works on cars/trucks, but not sure it is considered a business. --71.219.xxx.xxx

Your post reminded me of a CA law that allows a tenant to run a day care facility even if the lease expressly forbids it!

From the Internet:

"In California, the need for child care is considered so vital that state law gives renters the right to operate a family day-care business from the home regardless of whether their lease or rental agreement prohibits the “business use of property.” The law applies to all rentals, from single-family homes to apartments and condos."

Now, sometimes the Internet is not a good reliable source, but this is exactly what I vaguely recalled the law to be.

Check to see if your state has followed Cali's lead.

Mike, if it did have that law (which I'm pretty sure it doesn't), it would be one Va law canceling the other because the Va sex offender page specifically prohibits a Tier III offender from, going onto a school bus, driving a taxi or Uber, or cannot LIVE within 500 feet of a school or daycare facility. --71.219.xxx.xxx

I wouldn't spend so much time on this. First of all you probably dont want a business running out of your property. You are going to open yourself up to a world of headaches. Incoming traffic, neighbors complaining, city fining, not to mention the fact that you will have a bunch of kids in your house- age unknown...but who knows..tearing your house up. No thanks. Also the offender issue next door makes it a moot point. He has every right to live there. Even if she operates it under the radar parents will find out eventually. You never know what could happen, sue her, sue you? Just move on to another qualified applicant. --98.122.xx.xx
