Tonight a tenant on month to month paid up to Nov 1 let me know she was leaving at end of this month by text. I thanked her and stated 30 days notice was required, but I would count this as her 30 day notice. She fired back that she had already given me notice 2 months ago. I checked my phone and found this text from Sept 8:

" Me and my boyfriend are talkin about finding a house together 3 or 4 bedroom late October or maybe early November. I thought I should let you know."

I did not take that as 30 days notice as endpoint was vague. Still I can see where a tenant would consider it ample notice. --216.23.xxx.xx

Talking about it and a vague timeframe - doesn't count.

They are on the hook until the end of November.

Of course, they won't pay rent for November.

I suggest you send a properly-worded note to them, acknowledging that they have given you notice (today) to vacate. Try to get their signatures, but put in it that if they do not reply to the contrary in 3 days (or whatever - soon), then it is understood by all parties to be true. Also tell them to be sure to notify you in writing, formally, when they are officially returning possession to you. Let them think it means they can get their deposit back faster. In reality, it can let you have possession sooner without going to court. You will be able to PROCESS their deposit sooner. And you'll be able to start turnover sooner.

You will still have their deposit to apply to unpaid rent. --68.229.xxx.xxx

Vague? Yes.

Worth arguing? No.

They gave you a heads up so you could plan accordingly.

Strengthen your lease. I consider any misunderstanding as my error for not communicating clearly.

My lease is clear: Enclosed in this lease is a form to report your Notice of Intent To Vacate. Notice is only accepted on this form. Any other communication (text, voicemail, email, verbal, etc) is not accepted for notice.

FYI Indiana law allows LLs to enforce a 30 day notice period.

My lease is 60 days notice which helps give an extra buffer.
