My tenant that I evicted 8 years ago went thru a Syracuse city financed non profit and got a mortgage, bought a house last year. I got a judgement after an eviction and filed it in the county clerks office, making it a lien should they have property. How did the tenant able to get a mortgage without paying it off. Also I had a mechanics lien for work I did on someone’s house and wasn’t paid. The homeowner was able to take out a equity loan in spite of the mechanic lien 10 months after I filed. It has since expired. I’m beginning to think judgements are worthless. Does anyone know about this?

Judgments don't have to be paid off when acquiring a property, they must be paid off when selling a property. The judgment attaches to the property. Check with your attorney. Also google NOLO and NYS judgment liens to get good info. In NYS the judgment lasts for 10 yrs. I find NOLO to be a good resource for this type of info. --104.0.xx.xx

I know this doesn't apply in your case but Mechanics liens in NYS have to be renewed every year. Was this through the notorious "Syracuse Land Bank?"

Most tenants are not home owners for a reason, obviously and when they do manage to get into all these do gooder programs to buy a house, it usually falls into disrepair and foreclosure once all the freebies are gone. --72.231.xxx.xx

Make sure their new house has the lien on it to cloud the title when they sell / are foreclosed on.

In NY state a judgment is good for 20 years but only attaches to property for 10 years but can be renewed before it runs out.I have biught houses where i would put the judgment amount in the title companies escrow and when we reach the 10 year point i get the escrow money back once the judgment drops off my house.Keep in mind if the judgment is filed in a different county than the house they purchased your judgment is not attached until you figure out how to move the judgment to the county where the house is located.It is possible the title company simply missed it in the records when they did there search,if that happened you are actually ahead of the mortgage in position and should talk to an attorney --72.231.xxx.xxx

It was a judgement. I guess banks don’t check when buying. How do I renew lien from judgement in case she sells. It will be 10 years soon. Also I can check my county clerk online and see the lien when I enter my tenants name --67.241.x.xxx

I do NOT know NY law.

There are special rules for "purchase money loans." Your lien is probably junior to the purchase money loan that your ex-T took out, so the bank doesn't care about your lien.

As to the mechanics lien, was it perfected? I would guess that most of the mechanics liens I see are never perfected and do not constitute a valid lien.

Call the county clerks office and ask how to renew,you may want an attorney to do it.If your judgment is in the same county as the house they bought and your judgment was filed years ago you may want to talk to an attorney,you are ahead of the banks mortgage and someone should pay you off quickly so you dont foreclose when you notify them that is going to happen --72.231.xxx.xxx

Around here (finger lakes NY) you have to renew the judgement every year with the county clerk that the property is located in. I have a mechanic's lien against a guy who just stiffed us out of 50% of the bill back in 2018. He's elderly and owns a 6-8 multi bldg. --72.231.xxx.xx

put the fear into them and send them a notice that you are going to execute on their property. Figure out how to send a real notice, not a loosey goosey internet one. That way, if they contact an attorney, he will see that you truly can move forward. Here, not sure what the sheriff wants down before starting the procedure but I think at one time it was $5000 so you probably aren't going to actually do it if those are also your type numbers. --98.237.xxx.xx

Mechanics lien in NY is only good for a year,it is meant that once you file you will then sue so only good for a year.A judgment is good for 20 years no renewal necessary but the mechanis lien may need to be renewed --72.231.xxx.xxx
