Ok Part 2,..thank you for the original input ,..wondering if perhaps any further tips,..

so finally the courts are open to do them.We decided to just terminate their month to month tenancy instead for the many causes we had for violations of the rental contract. Thought that would be simpler that they couldn't argue all those points. Our lawyer who was recommended by our LL assoc agreed,..Actually in all these years of being a LL its been my only real eviction,..In other cases people have left with just a notice to do so.

This is this is the only building I have in Ma,..(others in NYS)

So now I find that they still can argue of why they are being put out which surprised me,.

These people are NOT going to want to go,.They are going to probably .say that they have Children and since the tenancy will end by Dec 1, that I understand many judges don't like to enforce evictions during the holidays, and then some don't like putting families out in the winter months in the north,,

I know I'm supposed to just let the lawyer handle this but wondering if anyone has experience /any more suggestions that even with a lawyer involved,.anything else.I should do,?

.. These people are so disruptive that I'm afraid I'm going to lose the other great long term tenants that I'm not sure they can stand the winter with these people.

I doubt that their tenancy ends on 12/01/2021. I bet it ends on 11/30/2021.

If they continue to be there on 12/01/2021 do you have a substantial increase built into your rental agreement? --71.184.xxx.xxx

Suppose the rental housing provider lived in one of the rental units where would have to respect the peace and enjoyment of other tenants no exceptions. When using the laundry room would empty out washing machines and dryers instead of leaving over night. Using the recycling system which is meant to reduce garbage going to landfills. Not sneaking in a dog then leaving the rental unit where the dog starts to bark. If they want free for all then rent or buy your own house where you can do what ever you want. Apartment living is apartment living which is completely different then living in a house. Vandalism to rental unit or common can not be over looked. Hopefully they will be able to learn about apartment living in the future. Now most jurisdictions vacancy rates are at zero or one per cent on and off where finding rental units is a extremely difficult task. --99.236.xxx.xxx

All of my tenants are MTM. That is for the exact reason that you are pursuing right now. I have never had to give a reason, so I don’t understand how they can argue it. Since it is considered a “ no fault” eviction- the judge will likely grant them a stay of 30 days. In my experience, If after 30 days they have done nothing to help themselves find housing they will not be given another stay. If they prove that they are really trying to find a new place but circumstances beyond their control are causing them problems they will likely get another 30 day stay. You would not have done any better with a “ For cause” eviction. Even on non payers I have had a judge grant a stay . I know it’s not supposed to work that way but it does.Be proactive. They usually try the excuse that there is nothing available or nothing that they can afford. The best way to avoid that is to bring print outs of all the local apartments in the same price range as yours to squash that . --68.191.xx.xx
