We have a super PITA (for other prior problems not related to her latest complaint.)

We have had a roof leak that we thought was fixed but apparently back. She is now claiming severe mold problems and its effecting her health.

Hard to know as she complains about many things We have no complaints from the other 9 tenants in that building Most others in the building do not get along with her

She is wanting to have her put up in hotels but we are not sure in this pandemic or whatever that we can get it fixed rt away, The guys we usually use are 2 months out. called 8 different companies days ago and have received no call back.One just said he would TRY this weekend as a big favor.

She is a young lady that in the last year 3 workers have told me they won't work with her as she is so nasty,

On top of it, she is kind of a slob and a hoarder, workers say they can't move around in her apt to fix anything.

If indeed there is "mold" throughout her unit as she maintains, I don't see how it can be treated, unless everything is moved out. (We offered the use of a powerful ozone machine with instructions on how to use it and how she had to be away during its use and for a few hours after the timer is off but she didn't want it.

So what I would LIKE her do is for her to move (for the other troubles she has called,not the mold claim) but I fear that she will say we are retaliating because of her complaints.

She is threatening to call the Board of Health, Free lawyer services etc.

She DOESN'T want to leave because otherwise its a nice unit and in her price range.

Also she has been there 3 years so I believe we have to give her 3 months notice in NYS (she is MTM)

Again, we have a roofer coming out as a big favor as he is 2 months backed up....so I think the LEAK should be fixed,

But I really would like to get rid of her. (One worker tried to take a picture of her ceiling damage but she ripped out his phone camera out of his hand and deleted all his pictures because she complained that it included her stuff/mess which was a violation of her privacy. ..

Offer to call any roofer she recommonds. Offer her deposit back in full to move. You are offering all these options for her benefit. Why does she still live there if it's so danangous. Have you visited the property and documented pictures of her concerns? Make a time line of all text, phone call, verbal exchanges, roofers called etc. Date. Time. names and numbers. Deal with her now. Today

You can purchase a self testing mold kit, you take samples and then mail it to a lab. Or you can hire a professional to conduct tests.

If the rental unit is crammed with combustible materials it is serious fire hazard where that impairs the safety of other tenants in the building where here can evict as that is very serious violation. If the smoke alarm was tampered with then take pictures. --99.236.xxx.xxx

Home Depot has a mold kit that is sent away and will tell which of any is there. It gives the same results as a $600 mold tester and I know because this happened to me. My tenant wanted to move and was afraid she would not get her deposit back due to damage so she was causing trouble. She got the HD test and it was the same result as the $600 guy who told her to shut the windows and put on the AC. No harmful mold. If window AC units are not tightly fitted, this can happen. --108.24.xx.xx

I'm just throwing this out there, because you said you thought it was fixed, but it's back.

I had one like that before - tried a couple times to find the leak, used a bunch of roof tar - only to find out it was an uninsulated bath exhaust vent.

Your leak isn't in the bathroom, is it?

The solution to a problem like mine is to go into the attic and fully insulate the vent pipe from the ceiling to where it goes outside. True, this is more problematic in colder weather when the hot moist air from the bath meets the cold pipe in the attic, water condenses and falls back down to drip out of the ceiling near the vent (or under the pipe, if it goes horizontally) --68.229.xxx.xxx

Carol,

I would use her complaint as a reason to end the lease.

"We have examined the situation and deem this apt is temporarily unfit for habitation until repairs are completed. Your Security Deposit will be refunded provided there is no damage and no rent or fees due."

I will agree that SOME people are affected by mold or mildew in a home, even certain wall paints, carpet, and vinyl floors.

Mold test: Yes your rental has mold. It's EVERYWHERE, indoors and out. You and she are breathing it in right now.

I had an eviction couple countersue us for mold so I got 4 $9 tests from Menards. One in living room, bedrooms, and one ont eh front porch. All four looked exactly the same after a few days. The "pro" quoted $60,000 to remediate the mold in my $35,000 rental.

We finally found a 6" circle of old mold in the attic where a the former roof had dripped. Put a little bleach water on it. Done.

Put eyes on this. How big is this issue? Many mold issues are a matter of spraying some bleach water on it. We use JOMAX from Menards. Let it air dry. Helps stop the mold from coming back.
