Being suited by former tenant. Long story. Got letter from our lawyer today. Sent letter from former tenants lawyer telling them, us, our lawyer and the court that he no longer will represent them.

Yes, time to go on the offensive and consider lawsuit against tenant since this does make tenant case look weaker.
Maybe tenant lawyer got a look at your rental agreement which hopefully has limit on attorney fees for all parties to $500 or even zero.

My mom had a tenant who was suing her over a "mold" issue. Their attorney was an up and rising attorney in the area and took the case thinking "big money".
They did a mold test and we did one which showed there was more mold outdoors than there was inside. Shortly thereafter, their attorney withdrew from the case. If you had ever met the tenants you would know why he did so rather quickly. --99.165.xx.xxx |

I have gone up against lawyers 3 times (won all 3). In one the tenant's lawyer quit. She quit because her client (tenant) was a psycho (but a collectable psycho) and the lawyer reached the end of her rope. I saw it again and again (due to multiple small claim suits) tenant ignored lawyers advise.
Yes, it is a win for you in many ways. Tenant will remain crazy and take that behavior into the courtroom.

There are generally one of three reasons why a lawyer will quit.
(1) The client is not paying as agreed. This presupposes a retainer agreement under which the client is paying the lawyer (as opposed to a contingency fee agreement). I knew one attorney who was being paid in non-monetary benefits, who quit after the client stopped sleeping with him.
(2) The clients are unreasonable and the attorney gets tired of dealing with them.
(3) The attorney discovers that the facts are not as the client had represented. If the lawyer takes a case on contingency and suddenly discovers that the liability is questionable and/or that the damages are much less or are much more speculative than he had believed, and/or that the defendant is judgment proof, the attorney will often bail out. If it is not too late!
Having an attorney withdraw from a case, the client is often hard pressed to find a new attorney to take over.
