I went to court and won a judgement against a 22 year old tenant.

This person said there were no jobs,.....

So he didn't pay the rent.

Had he just left when he said he would have, I would not have needed to go to court. My thinking is he is going to do this to you next.

So, If you check references you should be safe.

(I still need to report the judgement.....I don't know how that is done so somebody guide me through it. I imagine when I get the judgement on his credit report you good landlords will spot him as a bad apple).

Postscript. I understand tenants will have troubles and go bad...fail. But a tenant that doesn't leave, I consider them aggressive and dangerous to all landlord families.

You can also report tenants here on this site without a court judgment.

In NC, we can't get a financial judgment if tenant doesn't show up to court for the eviction hearing - we would have to sue them separately for money owed. If we knew where they were, if they are still in the state, etc. So filing here instead makes sense to me.

I am not sure on the details of your court but here in OH you get 2 court appearances for the price of eviction filing (first possession, then money or damages award) and then you get a 15,000 cap on damages, if you only file a small claim case you are capped at 5,000 damages, so I suggest you follow thru with the money judgement and this way you are backed by the court award and can use this to collect the awarded amount. If you go ahead without court it becomes your word against defendant which could lead to a whole separate court process with you being the defendant. Also some states have a policy on the accounting statement going out (here it is 30 days) to old tenant, if proven you did not return amount owed to tenant or due bill you get charged double or triple the amount of security deposit - any nearby landlord should be able to quickly answer your question about the deposit and timing policy. --76.188.xxx.xxx

We file on everyone who owes. My state’s fees are $135 so not a hardship for us.

First objective is a little mild “revenge”.This will stay on their record. We warn them about that before filing so it’s not surprise nasty revenge. If you are going to stonewall me, not apply for assistance, make me take it to court, delay hearings…understand a court record is the path you chose.

In my state the EVICTION will not show on a CR but the damage judgment 60 days later will show but not for several weeks.

We file because most will pay (because we chase them) and some come into money - inheritance, lottery, etc.
