Well, Michigan Courts are 7 weeks out before a date is set to appear.

Not only that but all landlord/tenant cases are referred to Mediation before hand and that is only online.

I know the system is backed up but it is frustrating, as I am sure many LL's know by now.

Just venting, cause I am up tonight.

How long is the wait in your state?

Do your Courts hear your case or are you referred to Mediation? --67.22.x.xx

Indiana has a mediation program and started mailing a postcard about it to each Plaintiff and Defendant in newly filed cases.

It's not mandatory ...yet.

My local court has had mediation for quite some time. Granted it's not mandatory, but if you decline then the judge reschedules the case. If you accept then they allow you to come back in front of the judge after going in a side room to work out the details. Nothing says you have to work it out, but that's part of the game. --172.58.xx.xxx

I guess I mediate most of our cases.

I meet them at their new place and work it out. (I show them why they owe so much!)

They sign the court's AGREED JUDGEMENT form. On court day I hand it to the judge. (I want it to go on record.)

BRAD, You obviously have a good sense of humor, which is fine.

P.B. could be Peanut Butter, but there must be bread and jam or it is no good. Or, it could be Paul Bunyon, but I do not have a Blue Ox, so that won't work, although I do own and know how to use an axe. Or perhaps is means Pretty Beautiful, hmm, beautiful maybe.

No mediation here. But the one time I was in court in Virginia, that county had mediation. I was the defendant, Tenant alleged I improperly withheld her security deposit (I didn't.)

I tried to tell the judge that I no longer lived in VA - that I found out about the case by sheer accident (which was true, a notice was taped to the door of our old house) and that the property was in NC but she cut me off after I told her I was improperly served and said, "Well you are here now, aren't you?" True.

So I just shut up, but refused to compromise at mediation and we went before the judge anyway, who was super PISSED at me.

But then she realized that the tenant had indeed filed in the wrong state! Not only me, but the PROPERTY was located in NC. She had to dismiss the case, no jurisdiction. :) --50.82.xxx.xxx

I haven't had an eviction in a while so no first hand knowledge but I haven't heard anything about mediation so I assume we don't have it.

File with no notices required (unless you're in Philadelphia or haven't got the proper clauses in your lease), hearing in 7 to 15 days, file for possession day 11 after the hearing. --98.237.xxx.xx
