State Specific Question About: PENNSYLVANIA (PA)

Can I use the security deposit as a penalty to cover my time and costs to advertise, show, and re- rent for a person that leaves during a one year lease?

I did find another renter, I am prorating the rent and refunding the old tenant the rent that they paid for September.

My lease has a clause that says; "IN the event that the tenant should break this lease without the written permission of the owner, the unpaid rent for the remainder of this lease will become immediately due and owing to the owner."

does that hold true if I find another rentor? or can that be considered a early lease termination fee?

I had about 50 hours in showing, advertizing, answering e-mails, calls etc. Can this be deducted from security deposit?

Advertising cost are deductible.

Your time is not

Clean up and make ready is

If you clean up and make ready yourself,...it is iffy.

If you hire someone it is deductible.

absent an ELT clause in lease, tenant is liBle for the lesser of actual vacancy time or the ending term dat of lease.

If you hand to rent the property for less, old tenant if responsible for different Ce through ending date of their original lease.,...but this also is iffy.

You were lucky to find a replacement quickly.

Looks like a repeat of Dorie-PA posting below. No double dipping however rent is paid in monthly segments unless you are operating as a hotel which pays a hotel tax and overall costs 20-25 percent more than periodic rental units. If you operate a periodic rental you must issue a accounting statement showing damages as line items - I take photos but the tenant only gets to see these after a judge observes the damage and repair cost first - save the photos for court if needed. --76.188.xxx.xxx
