Just had a zoom seminar on local/regional LL rules and regs. I missed the first one that covered "Best Practices for Documenting an Individual's Need for Assistant Animals in Housing"

There's quite a bit of DON'Ts for Landlords including a flow chart about questions you may or may not ask.

The second session was the one I attended yesterday which covered Fair Housing and the Seven Protected Classes.

They then went into NYS Human Rights Law which includes:

Age,

Marital Status

Military Status

Sexual Orientation

Gender Identity or Expression

Source of Income

The attorney had handouts in pdf form. Hubby was shocked at all the rights the landlords DIDN'T have LOL. I remarked that it has been this way in the mid sized NY cities (upstate) for quite some time at least since the eighties and nineties.

They covered HUD testers as well as examples of "Disparate Impact" namely

credit checks

co-signor

income=4 times rent requirement

criminal background checks

prohibitions against certain breeds of dogs.

Also covered was the HSTPA of 2019 (specific to NYS)

I think hubby was ready to flip and sell after this seminar!

Richard, any suggestions on where to put the money? For me this is my second sojourn into rental real estate and for hubby it is his first. We just started (again for me) in 2019 before all the covid mania and shortly after the NYS HSTPA. He is currently rehabbing the duplex and then onto the SFH.

The extreme leftist think everyone should operate at a loss instead of breaking even or a bit above breaking even. Had some who wanted to bring in a dog in apartment complex where told that all the hardwood flooring and carpet would be ripped then replaced with commercial porcelain flooring along with more sound proofing where they would pay a premium in rent of $300 more per month to cover the extensive renovations to become dog friendly. Dogs and apartment living do not work out well. Make sure all utilities are separated out where those with unpaid utilities are not going move in without signing up. Unpaid utilities and unpaid rent go hand in hand together. Here vacancy rates are at zero or one per cent on and off where those with a credit score below the seven hundreds are going to keep looking. What are they going to do if the one out three is screened out where a responsible tenant was found. As long as the rental unit was not vacant. As immigration increases the supply of rental housing goes down. The refuges has to live somewhere. --99.236.xxx.xxx

One time a applicant said she was going to take to the human rights tribunal where on the credit reports the Cable bill and cell phone was over $700 dollars along she was on social assistance. I told here that if really wanted rental unit the rent would have directly from social assistance where she refused then never called or took me to the human rights tribunal. Most jurisdictions vacancy rates are really low where those one out three problem tenants holed up in relatives house or in a motel are going to be staying there. Unpaid utilities is non starter. Now very few rental units are all inclusive along with those that are the rents are really high where they unable to afford that rent level. Social assistance has threshold where many are finding really difficult. The hostile environment forced many of the smaller operators to sell houses and townhouses where the secondary rental housing has really become smaller. --99.236.xxx.xxx
