At court today I settled with our last moratorium problem child.
He kept saying he was never served but then complained tje sheriff’s papers blew onto the ground...telling me this while he is sitting the hallway at court. SOMEHOW he knew to be there:)
I showed him the ledger with every payment he made and how he fell behind starting in May ‘20, and even tho he made partial dribbles toward rent the total due kept growing.
Me: Do you understand the $4000 in rent os your responsibility?”
Him: It’s nobody’s fault.
BRAD
PS His total bill after cleaning and repairs came to $7090. He signed a Wage assigment for $40 per week.
FYI Indiana now allows $10,000 in Small Claims.

You did good. I would have said, "Forty dollars doesn't seem like much, but with every payment you're working towards a favorable reporting on your credit history -- "this guy pays his debt and is responsible"!

I had one on a payment plan of $175 for a $4,100 balance for damages. They made payments for 19 months and and then filed for chapter 7. So I didn't get the last $700 or so dollars. I elected not hire an attorney to chase after it as it would cost more than what I would get back. --24.101.xxx.xxx |

Thank you for the detailed scenario of the court case with the problem tenant. I hope that you will be able to collect all of the $7090.
I'm curious about how he slipped through the rigorous screening questions. Was he an inherited tenant or did he go bad prior to May 2020?

I am personally seeing more good tenants start to sour on me.......they are getting upset with the system in which they have been placed.

$40.00 could add up if not much effort required on your end.
And may not get the full amount. But some better than none.
We will often offer a payment plan just a little less than allowed garnishment payments. And explain to ex tenant it also saves them the garnishment court fees.
Plan B is to go thru the court to garnish the paychecks.
We collect on about 50% of the people. But 50% still better than nothing. --73.40.xx.xx |

I had a deadbeat skip out. I found out from his friend where he worked and had his wages garnished. About Xmas time his Mama called me and asked for me to be lenient so his kids could have presents. I told her no as he did not care if my grand kids had presents the year he owed.
Well, she sent me a nasty letter. I returned the letter, addressed to "The Mother of the Deadbeat who owes me money", with her name under it.
She then called again and said I was horrible and she was hiring an attorney as it was all over the small town what I had written. I said, "Did you open the letter?" She paused and said "Yes, why?" I said "Go ahead and hire an attorney as I am sure the united states post office would be glad to put you in jail for opening mail you did not think belonged to you, but because you opened it you did admit that you indeed were the Mother of the Deadbeat. Rich LLs get richer by collecting the money owed them. We bring in $3500 a month in old debts thru court, $15-$50/week at a time. Just have to stay with it. Many of those are still paying from debt created during the Great Recession. Collections is not hard if the LL will adjust their thinking and learn the system.
AND solidify move out procedures.
He has a good job with longevity and the $40/week is garnished automatically from his paycheck.

Screening: This family has been with us for years. We moved them from another of our rentals into this home. Everything has been fine for 10? years, until April 2020 when hboth their jobs closed for a time and she is now disabled.
In the end we filed because they kept lying about seeking financial aid. It's a shame because we helped them apply for the Indiana Emergency Rent Fund in March but the help never came due to govt's lack of effort. They were approved for all back rent and up to 12 months in Sept AFTER eviction in June. Too late to help.
The amount is high because we waited while the state kept promising. It just got too high, had to make a move.

I currently have a tenant paying $150 per week via cash app. One more payment of $75 and done. She also moved out early, forfeited her security deposit, and paid the next month's rent as penalty. Thankful! --174.249.xx.xxx |
