If tennant signs a 1 yr lease an prepays for 3 months then decides to try to move by new job can they get the prepaid rent back an can i keep the deposit because they break the lease ? --71.199.xxx.xxx

This is odd but they just gave a emailed 90 day notice an also turned off the power an water the next day an left keys inside locked rental...

No clause on early termination but they know the prepaid rent is nonrefundable [ 3 months] .

This happened yesterday an today with the place no longer having necessary services- electric an water...but theyre paid up till Oct 26 ..

I dont want to break any laws .One lawyer said file a detainer warrant for possession of property..

You signed a lease with them and took it off the market because of that. They are obligated to pay for one year under that contract. However, you are obligated to mitigate damages. This means you must try to re-rent the place. If you do that and it only takes a month, then you have to refund them two of the three months rent that you have, less any additional expenses incurred such as advertising. --73.194.xxx.xxx

I spoke with a lawyer that handles this type case .

The tennant is at fault an intentionally abandoned the property.I can take back posession an turn on utilities again.By them surrendering the keys an removing their things then shutting off utilities along with written intent to move ,I can take posession .Get pics of any damages ,look to fix anything an send a letter in the mail to that adress with notification of confirmed move out /abandonment/ take back .I may have a lawyer write up the letter to him.An no there is no 90 day notice stipulation anywhere or in the lease ,as he wrote up in his messages..
