I dont see the problem here. AG asks attorneys to voluntarily represent tenants pro bono. The eviction is "unnecessary" if , with legal representation, the tenant would win the case.

If a landlord loses just because the tenant has a lawyer, then either the LL had a poor case or a poor lawyer or both. --50.4.xxx.x

If the tenant was rent arrears due to difficult conditions then government programs should be able to cover rent arrears or they should have a rent repayment plan where over a period time the rent arrears should be paid. --99.236.xxx.xxx

Good point. I'll add that it's not just the renters who are speaking out, it's also the politicians and the do-gooders who want to spend our tax dollars.

That $45 billion came from LLs!

Interesting that the homeless issue was gaining publicity when the eviction mort came around. Great combo for the news.

It sounds like messaging to me. The woke law firms making sure that every lower court judge, and attorney knows that they will not be hiring the non woke.

They are NOT "unnecessary evictions"

They are theives, pure and simple.

Between the ramped up unemployment, the stimulus money, and all the other give aways, there a NO REASON for people not to pay rent in most cases.

There are STILL people who call it a "rent moratorium". I've corrected SO MANY people about that! There has NEVER been a moratorium on paying your rent. NEVER! --149.76.xxx.xx

If you can't evict a tenant solely because they got legal representation, you should re-examine your case and/or your own legal representation (if I am at the point of evicting a tenant, I hire the best eviction attorney who only does evictions)

If you have a problem with a tenant being represented by legal counsel, you don't have a problem with moratorium, woke corporations or law firms. You have a problem with the adversarial legal system .

The news make it sound like housing providers/landlords wake up one morning; drink some coffee while sitting by a pool and thinks..."I need evict someone...Joe renter it is."

But in all the court cases I have been involved... there was back rent owed. All the cases I have heard before mine... $$$ owed and maybe some other miscellaneous bull that the judge doesn't really care about. Either way; eviction granted unless the attorney didn't file papers the correct time (seen once). --76.77.xxx.xxx

When our president extended the moratorium and announced on TV that he knew it would be overturned by the Supreme's but did it anyway. What do you think some lib lawyer/judge will do to us? You don't think they'll follow the law? Who will stop them?

We as LL's must commit, as should other professions, to watch the ballot boxes or man the polls or even campaign for those willing to follow the law. 13 months from now.

I usually prefer my opponents to be represented by competent counsel. Otherwise, the judge will put all of the burdens on me -- such as drafting jury instructions, jury verdict forms, briefing legal issues, etc. And competent opposing counsel are often somewhat reasonable and know what issues to fight over and what "issues" are really non-issues.

However, in evictions during Covid, the rules are so biased against LLs that having an unrepresented T is easier! How many judges will allow the LL to look beyond the pro-forma CDC Declaration and examine the T as to the truth of those declarations that the T didn't even read before he signed? I was evicting a T whose income went up due to the bonus income from Unemployment and I had to beg the judge to let me examine the T as to the truth of his CDC Declaration. If he were without representation by a free Legal Aide attorney, he would never have completed the CDC Declaration and the moratorium would not have been invoked.

Don, there are a handful of “landlords” here who are total progressives. Easy to identify and easier to disregard once you know who’s who. If they were to actually put their words and ideas into actions, they’d almost have to kick the paying tenants out of all their units and house the Covid cons for free this whole time. We are using 6 month leases now. In our state we can not evict for non-payment but can evict for end of lease and non-renewal. I market it as less of a commitment for the Tenant but it is for my benefit too. Good tenants want to renew and it makes it easier with bad ones to just not renew.

I think it will be years if ever before LL rights are on par with Tenants. We need to use the laws to our advantage even if it is a bit more paperwork. --172.58.xxx.xxx

Call me crazy but i don't think it was a coincidence that de facto rent control was issued statewide in NY or at least a built in trigger for it in July 2019.

Now that the plandemic has created an artificial housing shortage, the govt can cry "vacancy rates are lower than 5%!!!" And trigger state wide rent control. NY and CA are blueprints for what the feds want to do nation wide. (Also an excuse for building "affordable housing" tenements in suburban SFH zones) --174.208.xx.xx
