I took a holding deposit for a sept 1 move in. They made the deposit thru paypal, holding fee agreement signed. They changed their mind and told paypal I took their money without their permission and paypal has no system in place to defend yourself. Needless to say I dont want this person as my tenant. Any up front or move-in money is cash only, handed directly to the teller at my bank. I don't touch it. After new T gets the keys, cash is no longer accepted.

First month's rent and security/cleaning deposit accepted only in cash. After that checks are OK, but so far, in the past 4 years, my tenants continue to pay me in cash. Weird. I don't mind. Cash only on the first monies is a good thing, and I do keep the pile of cash untouched 'just in case' of a snafu. Had to refund it twice so far when things went sideways. --72.207.xx.xxx

Maybe it works well and I just have unnecessary concerns but I have never wanted to use anything that prevented me from approving the payment before depositing it.

I refer to the person on the check and the amount, not to mention the crucial issue of whether I want to accept any money such as in the middle of an eviction which would require that I start the eviction over from the beginning.

With regard to the amount, collecting excess rent even a small amount can be a legal problem here. Also accepting payment from a different person other than the tenant might provide certain tenancy rights to that person.

The legal issues above can be a minefield here.

If there are ways in which others on this board avoid the potential problems above but still accept rent in more convenient and modern ways, I would be definitely like to hear about it.

If they opened a dispute with PayPal, did you respond to PayPal about the dispute? Did you have a signed holding fee agreement?

I’ve used PayPal as both a sender and receiver. I’ve used their guarantee both ways as well.

When the customer, you need to supply proof of not receiving the provided service. I had to fight one up three levels. Once I supplied my proof to the right person (I had paperwork fro FedEx that a tracking number was never actually addressed to me, at my address, so that while the tracking number was delivered to an address in my zip code, it didn’t come to me) I got my refund.

At the same time, I had accepted a holding fee from an applicant. Applicant wanted to cancel, but wanted a refund. They signed a holding fee agreement using DocuSign. I supplied the email and texts conversations we had, as well as the DocuSign document with their name, email address, and the IP address and location data that is part of the DocuSign document/certificate.

I won.

It takes work, but if you have the documentation, you can win in a PayPal challenge. You might need to get on the phone with an agent or you may need to follow up by using the email addresses found on the Chris Elliott website. --149.76.xxx.xx

I do NOT want to put my applicants at risk and demand "cash only" for the move-in fee's. So I request a local bank's Cashier's Check made out to me at lease signing. The lease provides the keys will not be turned over to the new tenants until after the Cashier's Check is Cashed and that's when the tenancy officially starts. If the applicants "wants" to provide "cash", I will accept it so long as we meet somewhere safe.

Several of my banks will allow me to conduct limited business in their lobby, such as handing over funds. If we have to review the lease and I'll need to explain it, that can't be done in a busy lobby. --47.155.xx.xxx

Bet was screening applicants, looking for reasons to reject…he found reasons. He spent little time on a bad applicant, which is as it should be.

Now you would say that bet would be better off to drive across town, meet a stranger, collect cash for application fee, then drive home to process application.

Barb, I could not find any place to lodge a defense or counter claim. I will try to call them Monday. They signed a holding fee agreement and sent me the fee (one months rent) via paypal. They said I took the money from them without authorization, which is going to be hard to prove since they sent it to me. But now my account is negative the amount of the holding fee. Applicants; complete application, once thoroughly screened. I meet them at property. I tell them if they want the apt to email me the rest of the supporting docs and a deposit.So going forwarding, I plan to have them give me supporting documents and then I will meet them again at the apt to collect a cashiers check and sign the holding fee. I dont review the lease with them beforehand because they would run away if they read it, lol Really I have had so few vacancies these past 2 yrs, I am getting a little rusty.Time to tighten ship again. --73.227.xxx.xxx

Might be, they have undeclared income of some sort, and depositing it in a checking account could lead to ... questions. If they CAN'T have a checking account, they may be here illegally, or are a fugitive/hiding from stalkers/relatives/etc. If they're old enough/paranoid (reasonably, in many cases)... they just might not trust banks to properly manage their money.

Re: "... paypal friends and family payment. If I were to take paypal I would require it to be sent that way." You could lose your account, if you use "Friends and Family" for business purposes.
