Well now I have a war on my hands. I served my tenant with a 10 day Cure or Quit notice for unauthorized dog which they have running around off leash and has been jumping on downstairs neighbors. Still running around today after last night's discussion. The wife upstairs has bad scratches over her legs. The dog is actually a puppy about 10 weeks old and looks to be pure pit bull. I had the County Sheriff serve notice of Cure or Quit. They also have a rabbit now. and he got married and moved in his wife without letting me know this month. Fine, you can add a wife just let me know who she is, her contact info, and I will add her to Lease. I went to upper today to see outdoor furniture which was chewed and to talk to upper wife.

As insurance, I served a 30 day Lease Termination as I decided even with puppy gone I did not like his lies and attitude. "I haven't read the Lease in 2 years. How was I to know I couldn't get a dog? I have been a good tenant, why are you doing this over nothing.?"

The down Tenant called me after getting my Termination notice and I told him I was also getting him served with a Cure or Quit as well. He was quite irate, with his wife screaming at me in background. Started complaining about all the times he did not call me about uppers arguments. I said stop slinging s#$t we are dealing with your unauthorized dog and your allowing it to hurt other people without restraint. OK. He said he is moving and will be out ASAP. Good. Keep me informed.

2 hours later phone calls start coming in and text messages. Upper wife was coming down their stairs on phone while talking to her husband at work, when downstairs wife was waiting for her and went on the attack on porch. Male downstairs got into it also and both called the cops. Neighbors saw the entire fight. Upper husband heard the battle begin over phone and left work to come to his wife.

Bad boy is texting me now claiming the upper wife called him "nigga" and his wife "nigga lover". Then said he was driving around to cool off. I did not text back as I have said all to him I have to say. I knew race would enter in before it was over. Talked with upper Tenants and asked them to please not retaliate in any way and let them leave peacefully.

Funny how people get bent out of shape over anything.

I prefer empty houses to drama. I was happy to read you wanted these people out.

There are always good teni out there...We must always remember this and not try to save bad ones.

Why are you speaking with them on the phone? You served a notice, what more is to be said? You’re just adding fuel to the fire by engaging. It’s time to stick to written communication.

When they start dragging in other parties, you know it was the right decision. Just let calls go to VM and listen afterwards. You don't have to respond to rants, only to real maintenance issues. A friend rented to a college student because he remembered how hard it was for him to find housing when he was going to college back in the 1980's. The tenant, barely 20 year old, didn't know he couldn't:

A) Smoking inside the unit wasn't permitted, tenant thought he couldn't smoke only the common areas.

b) Parking an extra car in another tenants spot when someone was at work.

c) Buying a motorcycle and starting it up before 6AM or after 10 PM was normal.

d) Allowing friends to stay over and party all night, drinking and taking drugs.

The kid didn't know that he wasn't free to do anything he wanted, after all he was paying "rent".

What the landlord should have done is question the kids ethics and present applicant with "House Rules". So the person looking to rent understand they can do NOTHING that will interfere with others peaceful enjoyment of their rental too.

I returned upper tenant's call. He said he was on phone with his wife when they confronted and trapped her on the porch. They would not let her go back inside her unit or leave. She jumped over railing to escape. He left a voice mail telling me this and he called the

cops. I am not talking or texting lower anymore. I did Quit or Cure Notice to evict because if they do not get rid of dog or get out ASAP I have ability now to evict. The 30 day notice is insurance because even if they cure, I want them out. I had said at time of termination notice if dog was gone by July 31 I would "consider" letting them stay. I can do Emergency Possession here with hearing within 48hrs and immediate possession. Have done twice in 20 years with two different judges. Just have to draw up letter to court. I am pondering. I love pets......but you need to know when to say when. That dog is acting in a manner that is going to get someone hurt and the owner doesn't seem to care.

The moratorium does not apply to safety matters like the ones your upper tenant has called police about, get a copy of the police report to bolster your case, the glock does not send out enough pellets to dismantle the animal like a shotgun would. Let the police dissolve the pending breakup, once the tenant is in the greybar the animal warden can take away that problem leaving you with an unauthorized occupant to send packing. --76.188.xxx.xxx

Her replacement is an idiot who laughs at me and says my lawyer has to send a subpoena. Told her the Federal FOIA and Indiana Open Access laws say otherwise. It stinks when tenants go bad on us. I'm not sure if they really go bad unless they get into drugs or booze, but rather they get lazy on letting us know who they really are. The old phrase "familiarity breeds contempt" comes to mind.

Regardless, this is why I operate the way I do. A decade ago I realized I would never last in this business with all the tenant drama that doesn't concern except insofar as how it affects my properties.

Notices are professionally served, usually by mail or posting. They can argue with the mailman or process server.

All calls go to voicemail. If they're irate, I don't call back. Written communication only.

People will drag you into their drama, but only if you allow it. Ways to avoid it:

1) Do NOT go in person. EVER. I know, I know...we WANT to. Don't.

2) 98% of communication should be in writing. When someone sends me an "I need to talk to you text", I respond back, "Great, what's up?" I want to know what the landscape is before diving in. It's too EASY for a pissed off person to talk your ear off for 20 minutes. If they're going to whine, complain, etc, at least make them put in the effort of typing/writing it down, so you can show it to the judge later.

I've got more units than fingers and toes, and I do not have the emotional energy, much less the actual time on the clock, to deal with drama. I recommend asking yourself what, if anything, you gain by getting mixed up in all this? They're not leaving any faster because you went there and got insulted, so why go?

I spent this afternoon chatting with surrounding neighbors some of whom saw fight. All aware of dog problem. This helps get more perspective out of he said, she said situations and it always helps to know the neighbors around a rental and even give them contact info. It's clear lower tenants were instigators and upper wife did pop out the n-word under severe duress. I hope to keep uppers though. I suspect bad boy has fallen back into a drug or alcohol problem as he is nothing like the man I rented to. This is the scared wimp I had to rescue from a baby possum last year. --107.77.xxx.xx
