Just made the decision this morning that I was going to offer a tenant "cash for keys' to get out as they are causing tooo much drama...and had the cops there today for a domestic. So the frosting was on the cake and I was done dealing with it.

Low and behold, they are leaving on their own, know they forfeit their deposit and have given me forwarding information as well.

Pinch me... go ahead and pinch me? I have to wake up from this dream right???

I've had that experience twice in 23 years - both times the notice of non-renewal of MTM was written, but not delivered yet when we got written notification of them vacating.

Results? One left the place sparkling clean. The other? My worst cleanout ever, even now 13 years later.

I would offer to return some of deposit if all parties give you written notice, return keys, and leave no later than the date listed in the notice.

As an additional condition, you might even ask for separate written notice on day they vacate that they have removed all items from the premises and left the unit completely vacant.

It might be too much to expect it to be clean and they will probably just figure it's not worth the trouble to clean in order to get deposit back, and then they might delay leaving who knows how long.

After all, I think you would consider it a good deal to have them out given the unknown and probably long time frame for an eviction.

One major caution however. You said the cops were there for a domestic issue. If there is anybody else with right of possession other than person or persons giving you notice, you might need to address that issue. I would recommend legal advice from good landlord tenant lawyer before returning any deposit or taking possession if you do not have proper notice from all parties with legal right to possession.

I am having a similar issue but I bought this place with these yahoos in it on 12/31/20 from the county.

I offered cash for keys and they want more......and more.

I filed for an ejectment and the sheriffs dept. has been unable to serve these folks as they hide out. I have filed for alternative service via publication and the judge denied that. So I am on a letter writing campaign with the neighbors asking them to write me testimonials.

I am hoping the judge realizes that the sex offender that he is protecting is one vote but the 15 neighbors around him, are many more votes.

Toss in the COVID play and the folks are milking this --24.101.xxx.xxx
