Another person living at your rental is considered a squatter. And in Michigan squatters have rights. If you know they are squatting and do nothing they have the right to stay in the rental. You may not know their name, where they work, if they were convicted of being a child molester, and the list goes on. So, say your current tenant, who is on the Lease, moves out. The squatter has the right to stay and you don't know anything about him/her.
While I was in Court one day waiting, this scenario unfolded on a case. A squatter was not paying rent and did not have a written Lease, but said he did, just couldn't find it. The Landlord stated there was no Lease. The Court gave the squatter another 30 days to "find" the Lease. The case had already went on for 90 prior days. The squatter had a poverty free Attorney. The Landlord was extremely frustrated, but the Court was taking the squatters word. The Court stated that the Landlord should have made him stop squatting as soon as they knew he was there and because he was allowed to stay he had certain rights.
I never did find out how it ended as I didn't need to go back to Court.
I sure could feel for that Landlord though.
So, I believe I would fire your current PM and hire one who has your best interests at heart. The one you have now is not doing their job. --67.22.x.xx |

Most PMs are lazy and avoid conflict.
Yes the PM should get off their xxx and notify the res to cure the problems.
Overall this is small stuff. Don’t sweat the small stuff. Just everyday renter tricks. Deposit the money and go to dinner.

You or property manager should let tenant know you will be filing for eviction as soon as it's legal to do so unless they correct the situation. Even if you can't evict you can threaten to evict. Property manager should have at least taken this very simple first step.
